Dear Jennifer & Kerry:
As you aware, there is an easement for the benefit of the owner(s) of 5
Garside Rd., Saratoga Springs, New York, providing pedestrian access to
the Lake between lots #11 and #15 on the lot #11 side. My understanding
is that you are agreeable to moving the existing easement to the north
side of lot #11, immediately adjacent to lot #9. The new easement would
be identical to the current easement and, -like the current easement,
would run with the land_ I would be responsible for all costs and expenses
related to moving the easement. If my understanding is accurate, please
sign the bottom of this letter affirming your agreement and I will
undertake the necessary steps to effectuate the same. Thank you for your
anticipated attention to this matter.

SURVEY DESCRIPTION
REVISED 3-FOOT WIDE PEDESTRIAN EASEMENT
WITHIN LOT 11R — SANDRA E. GAETANO LOT CONSOLIDATION MAP
SARATOGA SPRINGS, NY
REVISED 3-FOOT WIDE PEDESTRIAN EASEMENT THROUGH ALL THAT CERTAIN
TRACT, PIECE OR PARCEL OF LAND SITUATE in the City of Saratoga Springs, County of
Saratoga, State of New York lying along the easterly line of Garside Road (Private Right-of-way)
and within a portion of Lot 11 IF, said lot a shown on a map entitled "Lot Consolidation Map of
lands of Sandra E. Gaetano", dated December 11, 2023 as prepared by The Environmental Design
Partnership, LLP and filed in the Saratoga County Clerk's Office on 12023 as
Map No. M2023 and being further bounded and described as follows:
Beginning at a point marked with a capped iron rod found at the point of intersection of the
easterly line of Garside Road (Private Right-of-way) with the common division line of 9 Garside
Road (filed Map No. G-291) to the north and Lot 11R to the south as shown on said map;
Thence from said Point of Beginning along said common division line the following two (2)
courses and distances:
1) North 67 deg. 29 min. 10 sec. East, 18.15 feet to a point marked with a capped iron rod found;
and
2) North 72 deg. 50 min. 00 sec. East, 135.28 feet to a point marked with a capped iron rod found in
the westerly line of Saratoga Lake;
Thence along said westerly line, South 18 deg. 52 min. 10 sec. West, 3.00 feet to a point;
Thence through said Lot 11 R as shown on said map the following two (2) courses and distances:
1) North 72 deg. 50 min. 00 sec. West, 134.11 feet to a point; and
2) South 67 deg. 29 min. 10 sec. West, 17.51 feet to a point in the aforesaid easterly line of Garside
Road;
Thence along said easterly line of Garside Road along a curve to the left having a radius of 141.00
feet, a chord length of North 14 deg. 05 min. 00 sec. West, 3.03 feet and an are length of 3.03 feet
to the point or place of beginning of said easement and containing 458f square feet of land.

The above described revised pedestrian easement is intended to replace and discontinue that 3-foot
wide easement running within Lot 11 along the original lot line between Lots 11 & 15 Garside
Road as shown on filed Map No. G-291.
Said easement made subject to any and all enforceable covenants, conditions, easements and
restrictions of record as they may appear.
