Hi All,
See below recap of the meeting and where everything stands at this point. A lot of the
questions were answered yesterday but a few outstanding items were still in the works:
I recall there was a letter form the applicant stating CDTA will be coming through that
area, although it was unsure as to exactly where drop offs would be official. I believe the
talk was on Bunny lake and on Jefferson. Someone else more versed on this can clarify.
Based upon communication with Jonathan Scherzer dated November 29, 2023, he
verified that the bus would be coming into the site to the bus stop depicted in our plans
as discussed with CDTA previously.
Fee in lieu for the Jefferson St. sidewalk. There is also a catch basin and outlet pipe
involved with that installation. Decision was since this work is in wetland or wetland
buffer, applicant could not install but City could. Large funding sources were in jeopardy
because site plan needs to be accepted prior to submission for these funding resources.
Correct. Fee in lieu for Jefferson sidewalk. Please also note that this is a possible
funding source. As explained, we will not know if this source is in play for quite some

time and can’t get to that answer without having an approved site plan, which is the
foundation for the construction budget.
Fee in lieu is already occurring on Crescent Ave however the fee in lieu needs to be
used on a different street. Confirm enough funds allocated so that the Jefferson St.
sidewalk is definitely built and Crescent Ave. sidewalk has some funding so City can
look to get more funding. Full fee in lieu is roughly $100,000 on Crescent and $50,000
on Jefferson. The applicant will confirm that the fee in lieu amount paid in will be
sufficient to cover the Jefferson Street construction by the city, but that the applicant
may seek some reduction in the fee in lieu amount from the city council. Such request, if
made, will ensure that funds cover construction and some contribution toward the
Crescent Street Connector.
Due to cost, maintenance, and wetland disturbance, no trail will be included. This was
the section along where the sewer main is being installed (which will most likely now be
directionally drilled in any wetland or wetland buffer zone). Correct
Passive/Active Recreation Area (0-3 acres) being looked into by Sara for SWPPP
conflicts with the entire area. Once SWPPP calculations are in, an amount of the 3 acre
lot could be designated to the City or none of it could due to the SWPPP calculations. It
was noted that if the lot remains under ownership of the applicant and not transferred to
the City, The City will not maintain that area. Sara has confirmed that conveyance to the
city of +/- 3 acres of land on the corner of Jefferson and Crescent will not adversely
impact the SWPPP or density of the project. Applicant is prepared to propose outright
conveyance of land in exchange for waiver of recreation fees, providing an easement is
granted back to Liberty for the installation and maintenance of the sewer pipe. In
addition, Class B conveyance of conservation easement will be made to the city for the
balance of the 20 acre area previously contemplated – which will result in approximately
17 acres being conserved.
In saying that, site plan adjustments, including bus shelter location shift and larger
playground on site, could occur based on talks near end of meeting. The bus shelter will
remain as located on the site plan. The playground as proposed is sufficient for
approximately 30 kids ages 2-5 and 60 kids in the 5-12 year old range. This playground
is to be used for the residents of the Liberty project, not the general public.
The striping through the racino parking lot can be removed, any monies that were going
to that would preferably help towards the sidewalk fee in lieu's or other areas we
discussed in the meeting. Agree on removal.
To help with funding, the City was hoping for a higher amount of rooms in the complex
to be at the 30% or less AMI, roughly 10% of total rooms. This would also help with the
funding source that cannot have work done in wetlands/wetland buffers and securing
those monies for the project. Liberty will commit to 10% of the units (not rooms) at or
below 30% AMI.
That was roughly everything we talked about and where it stands at this time. If I misspoke or
if a clarification needs to be made, feel free to reply all to this email so folks are on the same
page.
