KILEY (1975-2000) Re: 118 and 121-125 Woodlawn Ave, Saratoga Springs — Sixth Supplemental Submission and Response to Planning Board Comments Dear Board Members, Stachia Wagner Paralegal As you are aware, our firm represents EC Woodlawn Van Dam Property LLC (the "Applicant") with respect to the development of the above -referenced properties as a Private/Social Club, as such use is defined in the Unified Development Ordinance (the "UDO"). Below is a list of conditions that Applicant is willing to consent to being placed on an approval for a Special Use Permit ("SUP"). Items 1) through 13) were already provided in correspondence from my office dated September 8, 2023 — with the exception of number 10) which has been amended. Items 14) through 17) have been added based upon comments from the Board and the public. 1) 200 member maximum 2) Maximum occupancy of 75 members and guests at any time 3) Reservations only for dining — no walk-in dining for members 4) No signage 5) No outdoor activities whatsoever (no smoking, congregating on steps or in parking lot) 6) No amplified live music — acoustic only 7) Hours of operation Sam — 1 Opm Sunday - Thursday, Sam —1 1pm Friday Saturday 8) No events (weddings, receptions, fundraisers) 9) Lease of extra 10 parking spaces 10) Restore/Repair 119 Woodlawn, regardless of approval for SUP 11) SUP will terminate if property not leased to not -for -profit — the Woodlawn Club 12) Omitting all vehicular entry/exit to/from Bolster Lane while maintaining refuse removal through a 4' wide access gate connected to our on -site refuse enclosure with "residential style" rolling refuse bins. 13) Kitchen exhaust will be through roof. All 1st floor openings along north side of building will be infilled with brick. 14) Valet parking will be provided during the anticipated peak hours of 5pm to 1 1pm on Fridays and Saturdays. Valets will first utilize the on -site parking on Woodlawn, then the additional parking lot under lease on Van Dam. If additional parking is needed, the Applicant has arranged for the use of the parking lot located at 395 Broadway — a property owned by an entity that shares common ownership with the Applicant. 15) All deliveries will be conducted via personal vehicles (cars and vans; no large trucks). All delivery vehicles will unload in the parking lot on Woodlawn for delivery and not directly from the street. 16) The maximum occupancy of 75 members and guests will be monitored by an appointed staff person assigned with such task each shift. 17) The addition of Rectangular Rapid Flashing Beacons (RRFBs) to the existing pedestrian signs at the Van Dam cross walk at the intersection with Woodlawn. The RRFBs can be actively or passively activated when a pedestrian crosses Van Dam Street and would provide greater emphasis to drivers when a pedestrian is in the roadway. The Applicant appreciates the Board's consideration of the above noted proposed conditions and looks forward to reviewing the same in greater detail at the meeting on November 30, 2023.
