Saratoga Springs, NY 12866 From the determination of the Building Inspector involving the premises at 290 West Avenue in the City of Saratoga Springs, NY, being tax parcel number 178.4-24-1 on the Assessment Map of said City. The Applicant having applied for an Area variance to permit the fabrication and installation of a sign above the first floor at 290 West Avenue and public notice having been duly given of a hearing on said application on October 2"d, 2023. In consideration of the balance between the benefit to the Applicants with detriment to the health,safety and welfare of the community, I move that the following variance for the following amount of relief: Type of Requirement District Dimensional Requirement Proposed Relief Requested Wall sign above the 1 sT Not permitted Permitted 1 sign(100%) Floor As per the submitted plans or lesser dimensions, be denied for the following reasons: 1. The applicant has not demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant proposed a sign on the architectural detail of a second story location with signage already existing on the architectural detail on the first story location. The signage proposed for the second story did not reflect a business and did not conform to the style of type on the existing building. The applicant presented other options for the signage that would be allowable and the Board finds that these options would not require a variance. 2. The applicant has not demonstrated that granting this variance will not produce an undesirable change in neighborhood character or detriment to the nearby properties. Although the applicant stated that there were no other signs requested in the immediate vicinity, allowing second story signage sets a precedent in all nearby districts. The applicant also presented examples of other signs allowable on second story locations,however,the Board felt that the signage was at the bottom portion of the second story,not at the top of the second story. The Board also stated that the second story location was for the names of businesses located at the second story with no other location available for the signage. 3. The Board does find the variance to be substantial at 100%. 4. The Applicant has demonstrated that granting this variance will not have an adverse physical or environmental effect on the neighborhood. 5. The request for relief may be considered a self-created hardship. However, self-creation is not necessarily fatal to the application. Gallagher,) NAYES: 0 This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance.
