OF PAGES INCLUDING COVER: PHONE NUMBER: 9 SENDER’S REFERENCE NUMBER: RE: YOUR REFERENCE NUMBER: 38 Oak St. – ZBA Application Variance App. Revision & Lot Calcs  URGENT  FOR REVIEW  P LEASE COMMENT  PLEASE REPLY  AS REQUESTED To the City of Saratoga Springs Zoning Board of Appeals: Engineering America Co. herein respectfully submits the following materials & information for ZBA review of variances requested for proposed development at 38 Oak St.: 1)Carriage House Plans: The concept of a 2nd dwelling unit within the carriage house and on the pre-existing, non-conforming lot size, did not appear amenable by the ZBA Therefore, the applicant herein removes the request for the 2nd dwelling unit. The building plan is now proposed as a 1 car garage with a ½ bath on the 1st floor and conditioned space on the 2nd floor. No sleeping, cooking or bathing facilities are proposed within this structure. A plan is attached for review. 2)Reduced Footprint: The ZBA requested a reduction in the proposed building footprint. EACo. has modified the application & proposed plans to include a reduced footprint (see attached plans). This reduction in footprint also results in a lesser coverage variance being requested. This building size is more consistent with the previous historic barn of 16’ x 19’ (size without roof overhangs) which was taken down in 2022. 2 3) Lot Area Calcs: A question of permeability was raised: Existing Lot Area: 4, 500 sq.ft. Existing House Coverage: 1,512 sq.ft. Proposed New Garage: 462 sq.ft. Total Structure Coverage: 1,974 sq.ft. = 43.8% coverage (44% requested) Paved Area & Walks: 750 sq. ft. (+/-) Total Proposed Impervious: 2,724 sq.ft. = 60.5% impervious < 70 % max. allowed 4) Plot Plan Modification: The ZBA discussed concerns about the proximity of the proposed structure to Western Alley. EACo. has attached a modified plot plan: a. A corner side setback (front to Western Alley) is depicted at 3.2’; b. The side setback to the West is noted as compliant at 5.2’ (5’ min. allowed) c. The side setback to the South is noted as compliant at 8.4’ (8’ min allowed). 5) Modified Zoning Variances Requested: a. Min Front Setback (Corner Side) to Western Alley: i. 8’ min. Corner Side required ii. 3.2’ proposed Corner side to Western Alley iii. 4.8’ relief requested = 60% variance b. Total Coverage: i. 40% max. allowed ii. 44% coverage proposed iii. 4% relief requested = 10% variance c. Min. Lot Width: A lot width variance is no longer required as the 2nd dwelling unit is not being proposed. d. Min. Lot Area: The lot area variance is no longer required as the 2nd dwelling until is not being proposed. We believe that the application modifications submitted herein, along with the neighborhood area & coverage date previously submitted, depicts that the proposed 1 car garage with conditioned space above, is consistent in character with the existing community and does not result any environmental impacts.
