The applicant having applied for an area variance under the Zoning Ordinance of said City to permit the expansion of the principal home in the urban Residential -3 (UR-3)District and public notice having been duly given of a hearing on said application held on October 2"d-November 6", 2023. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amount of relief: TYPE OF REQUIREMENT DISTRICT REQUIREMENT PROPOSED RELIEF REQUESTED REAR 25' 17.3' 7.7' (30.8%) as per the submitted plans or lesser dimensions,be APPROVED for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant wishes to construct an expansion of their current home including a garage in the rear of the property. The applicant notes they have considered other alternatives. The Board notes the applicant made significant changes to reduce the initial relief request and finds the current requested relief appropriate for the neighborhood. 2. The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. The applicant provided comparable properties in the district. The addition is consistent with other properties demonstrating that it does not alter the current character of the street/neighborhood. 3. The board notes that the requested variance is substantial, but mitigated due to the reasons stated above including neighborhood context. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. Standard district permeability requirements will be met. 5. The alleged difficulty is considered self-created insofar as the applicant desires to construct the addition however, this is not necessarily fatal to the application.
