Julia, I appreciate your offer to have this letter and all attachments made available for the Zoning Board. We were instructed to have all documentation in prior to noon on Monday, November 6th per Amanda Tucker, RA, Senior Planner on Friday, November 3rd. We have read all documents/application and attachments submitted and on file for this project. Attached is a petition signed by neighbors that received notification of this project that are against this variance for the purpose of privacy and safety. We consider a second primary dwelling a detriment to our neighborhood. Serbalik told city officials she would be moving prior to December 2023. She stated she would be renting or selling soon. The letter accompanying the 23 page application by Serbalik states a request for “one additional dwelling and site setbacks”. Page 1, question 8- description includes “rental for 30 days or more”. Question 9 appears to have both Y and N checked. This parcel has written violations. Page 6- Required setback is 12 feet. Applicant requesting 7.9 feet. This can easily be accomplished by removal of the “Supported Roof Overhang” built without a building permit. Granting this variance IS a detriment to the character of the neighborhood AND is a detriment to nearby properties. Although Serbalik states “I do not wish to sell or subdivide…… The design of the garage is a standard design and costs prohibit further design changes.” (She also supplied so called comparative photos that will be addressed later.) #5- Serbalik states she “did not do a detailed historical property study”. She assisted with the changes witnessed by us in early 1990s to create a living space above the 2 car garage. This and other projects were completed with her husband, the former owner. Important - 490 Crescent has deeded right of ways that track in two directions on the Serbalik parcel. National Grid had been consulted in prior years. Their utility lines cut straight back along the left side of the house (Serbalik) and building cannot be within 10 feet of their wires. This creates about a quarter of an acre of unusable property for #487 and has eliminated the ability to do a subdivision of said property in the past. 11/6/23, 11:38 AM Zimbra https://m.saratoga-springs.org/h/printmessage?id=21759&tz=America/New_York 2/3 Short Environmental Assessment #5- answered YES to the question that this is a permitted use under zoning regulations #11 - Septic is a concern due to the questionable construction and lack of a CO. #20 - Hazardous waste- Serbalik was noted for dumping of cat and dog feces along property line with 490 Crescent Avenue neighbor multiple times in 2023 by Public Safety. Page 13 of 23 - Aerial photo was taken between 11/1995 and 10/1996. After we witnessed the building changes. Extra note- it clearly shows the parking space in front of the home where her sign for the Zoning Board of Appeals was placed and can be corroborated with the photo sent to Zoning in a different attachment. Far from view! Page 17/23 - Photo at bottom depicts fence installed in April 2023 by LiCalzi’s due to multiple interactions with Public Safety, Code Enforcement, and Saratoga Police. (Including dumping of feces.) Page 18/23 - Distorted views to 490 Crescent. We invited the Zoning Board to visit in person. Page 20/23 - Homes # 663 and 672 are single family homes with attached garages. Home #77 is 2 miles away and Zoned UR 1. Page 22/23 - NOT #663! This is #457 Crescent Avenue. It is Zoned RR1 and has a sale pending. It is listed in tax documents as a “garage with flex space” and has not accommodated renters. Page 23/23 - Homes at #674 and #219 are both single family homes with attached garages. Attachment of 5 pages with US Post Office and photos of Zoning Board meeting - Photo #1 shows our name and address at 490 as being mailed the announcement from the Serbalik return address. Attached please find the photo of our envelope with the return address of her sister’s home across town. The photos of her sign being up are clearly within her front yard and far from street view. (Can be matched to her own aerial photo in the application.) Attachments will be posted in a second email. They will include the signed petition, the photo of the notice sent to us from the wrong address, photos from our front door of renters on the balcony, photos of signs and posters placed for our viewing pleasure, our view of the spotlight and landing of second story stairs that has been turned on our home repeatedly, a photo of the view prior to our fence being installed, and the current occupant of the apartment that has been living there since the night of the first Board meeting on 10/23/23. We appreciate the time and consideration put into reviewing this project.
