From the determination of the Building Inspector involving the premises at 35 Newton Ave in the City of Saratoga
Springs, NY, being tax parcel number 165.57-1-60.1 on the Assessment Map of said City. The Applicant having
applied for an area variance to permit a subdivision to create two parcels, in the Urban Residential (UR-2) District
and public notice having been duly given of a hearing on said application on March 13th and April 24th, 2023.
In consideration of the balance between the benefit to the Applicants with detriment to the health, safety and welfare
of the community, I move that the following variance for the following amount of relief:

City of Saratoga Springs Standard Notes
1. All work must conform to all Federal, State and City Codes, specifications, ordinances, rules and
regulations.
2. The elevation base for the contours and benchmarks are based on the National Geodetic
Vertical Datum, 1929.
3. Applicant must submit a Letter of Credit Estimate for Project Site Work to the City Engineer
for review and approval. Letter of Credit funds must be posted with the City prior to Planning
Board Chair signature on final plan.
4. The Contractor must schedule a pre -construction meeting with the City Engineer prior to any
construction. Construction inspections by a designated representative of the applicant are
required. The cost of the construction inspection is the responsibility of the
Applicant/Developer.
5. All proposed easements or rights -of -way dedications must be verified and approved by the City
Engineer prior to construction.
6. The Applicant must verify that the proposed project can accommodate the turning movements
of any fire truck that the fire department designates.
7. The Contractor must obtain a street opening permit from the Department of Public Works for
any work in the street or right of way of any City street or road or alley.
8. Contact the Building Inspector for a Blasting Permit, if blasting is required.
9. All points of construction ingress or egress shall be maintained to prevent tracking or flowing
of sediment or debris onto a public right-of-way. Additional erosion and sediment control
measures also apply.
10. All refuse, debris and miscellaneous items to be removed shall be legally disposed of off -site
by the Contractor prior to submission of the As -Built Drawing.
11. No Certificate of Occupancy will be issued until all site work has been completed in accordance
with the approved plans; all disturbed soils or bare ground have been fully stabilized; and an
"As -Built" drawing has been prepared in accordance with the requirements of the City Engineer.
Unauthorized alteration or addition to a survey
map bearing a licensed Land Surveyor's Seal is
a violation of Section 7209 subdivision 2 of the
New York State Education Law.
Only apparent easements (if any) are shown
on this survey. No abstract of title was
available.
