NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION

Involving the premises with tax parcel # I 9 I .-2-26 & 49, in the City of Saratoga Springs, on an application for a
permanent special use permit for a marijuana dispensary in the Gateway Commercial - Rural (GC-R) District.
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II SEQRA Action:
• (9) construction or expansion of a primary or accessory/appurtenant, nonresidential structure or facility
involving less than 4,000 square feet of gross floor area and not involving a change in zoning or a use
variance and consistent with local land use controls, but not radio communication or microwave
transmission facilities;
Having properly noticed and conducted a public hearing on October I 2, 2023 as required on the proposed use;
And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the
proposed use(s) will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, Article
I 3.4 "Special Use", the Planning Board issues the following decision on October I 2, 2023 (passed 4-0 — in favor:
Mayo, Marshall, McTygue, Morrison):
C� Issue a permanent special use permit for a marijuana dispensary (approximately 3,950 sq. ft.) with secure deliverX
court and associated site work as shown on site development plan dated 8/9/23.
Condition:
• Site plan review and approval required per I 3.5 "Site Plan Review" in the UDO.
Note: this approval shall expire I 8 months from the issuance date unless all conditions have been complied
with and a building permit issued.
