To the City of Saratoga Springs Zoning Board of Appeals:
Engineering America Co.Herein respectfully submits the following materials&information for
ZBA review of variances requested for proposed development at 38 Oak St.:
1) Reduced Footprint: The ZBA requested a reduction in the proposed building footprint.
EACo.has modified the application to include a 17'6"x 19'carriage house. The
footprint with the roof overhangs results in 19'6"x 20'.This reduction in footprint also
results in a lesser coverage variance being requested. This building size is more consistent
with the previous historic barn of 16'x 19' (size without roof overhangs)which was taken
down in 2022.
2) Carriage House Plans: The ZBA requested that concept plans for the carriage house be
submitted,which would provide community context along the alley as well as the size of
the proposed apartment living space. EACo.has prepared concept plans (attached)
which depicts a 1 car garage,,-,7th a 245 sq.ft. studio apartment above).
3) Lot Area Calcs: A question of permeability was raised:
Existing Lot Area: 4, 500 sq.ft.
Existing House Coverage: 1,512 sq.ft.
Proposed New Garage: 400 sq.ft.
Total Structure Coverage: 1,912 sq.ft. = 42.5%coverage
Paved Area&Walks: 800 sq. ft. (+/-)
Total Proposed Impervious: 2,712 sq.ft. = 60.3%impervious < 70%max.allowed
4) Plot Plan Modification: The ZBA discussed concerns about the proximity, of the
proposed structure to Western Alley. EACo.has attached a modified plot plan:
a. A corner side setback(front to Western Alley)is depicted at 5.5';a 3'
improvement from the 2.5'setback originally requested.
b. The side setback to the West is noted as compliant at 5'0" (5'min. allowed)
c. The side setback to the South is noted as compliant at 9'.0" (8'min allowed).
5) Modified Zoning Variances Requested:
a. Min Front Setback(Corner Side) to Western Alley.
i. 8'min. Corner Side required
ii. 5.5'proposed Corner side to Western Alley
iii. 2.5'relief requested = 31.25%variance
(This is a T-0"improvement from the 2.5'setback requested in the
original application).
b. Total Coverage:
i. 40%max. allowed
ii. 42.5% coverage proposed
iii. 2.5%relief requested = 6.3%variance
(This is a reduction from the 46.3%coverage and 16%variance
requested in the original application).
c. Min.Lot Width: The lot width variance requested in the original application has
not changed as it is not feasible to increase the width of the pre-existing/non-
conforming lot.
i. 80'-0"lot width required

iv. An aerial map has been attached which depicts 30 lots in the immediate
adjacent neighborhood.
1. 15 of the 30 lots are listed as 2 Family or a higher density.
2. All of the 15 lots with more than 1 dwelling unit have lot sizes
less than 80'.
d. Min.Lot Area: The lot area variance requested in the original application has not
changed as it is not feasible to increase the size of the pre-existing/non-
conforming lot.
i. 8,000 sq.ft.lot width required for 2 dwelling units
ii. 4,500 sq.ft.lot area existing
iii. 3,500 sq.ft.relief requested = 43.75%variance.
iv. An aerial map has been attached which depicts 30 lots in the immediate
adjacent neighborhood.
1. 15 of the 30 lots are listed as 2 Family or a higher density.
2. All of the 15 lots with more than 1 dwelling unit have lot sizes
less than 8,000 sq.ft.
