The Applicant having applied for an area variance to permit a second story addition of a master bedroom to the residential structure in the Urban Residential 1 (UR-1)District and public notice having been duly given of a hearing on said application from July 24a'to September 25a', 2023. In consideration of the balance between the benefit to the Applicant with detriment to the health, safety and welfare of the community, I move that the following variance for the following amount of relief- Type of Requirement District Dimensional Proposed Relief Requested Requirement Interior side (West elevation) 12' 4' 8' (66%) Interior side to covered landing 12' only(West elevation) 2.5 9.5 (79.2%) As per the submitted plans or lesser dimensions,BE APPROVED for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant considered other alternatives,however the bearing walls, and roof structure of the house make it structurally and financially difficult to complete the proposed addition. 2. The proposed renovation and additions are consistent with other homes on Briarwood Street and other properties within the Geyser Crest neighborhood. The applicant provided comparable properties to the board within the district to demonstrate a consistency in neighborhood context. Also due to the setback of the existing home and any modification to that side of the home would trigger the need for relief. 3. The requested variances are considered to be substantial(66%and 79.2%)however, it is mitigated by neighborhood context as stated above. 4. The Applicant has demonstrated that granting this variance will not have an adverse physical or environmental effect on the neighborhood. Standard district permeability requirements will be met. Page 1 of 2 5. The request for relief is a self-created hardship. However, self-creation is not necessarily fatal to the application. It is so moved, September 25,2023 Adopted by the following votes: AYES: 7 (G. Simpson, C, Grey, E. Bergmann, S. Gaston, B. Dailey, A. Smith, B. Gallagher) NAYES: 0 This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance. I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the Board being present.
