NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION
#20230467

Involving the premises with tax parcel # I 65. I 8-2-5. I I , in the City of Saratoga Springs, on an application for a
permanent special use permit for a marijuana dispensary in the Neighborhood Center (T-5) District.
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II SEQRA Action:
• ( I 8) reuse of a residential or commercial structure, or of a structure containing mixed residential and
commercial uses, where the residential or commercial use is a permitted use under the applicable zoning
law or ordinance, including permitted by special use permit;
Having properly noticed and conducted a public hearing on August 3, 2023 as required on the proposed use;
And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the
proposed use(s) will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, article
I 3.4 "Special Use", the Planning Board issues the following decision on August 3, 2023 (passed 5-0 — in favor:
Torpey, Fabozzi, Marshall, McTygue, Morrison):
C� Issue a permanent special use permit for a marijuana dispensary (approximately 3,000 sq. ft.) within an existin�
shopT laza �tenant space within the buildin� identified on aerial photo�
Condition:
• Applicant shall submit a site plan addressing Special Use approval standard "safe and efficient pedestrian
and vehicular access, circulation and parking" ( I 3.4 E.4) for further review by the Planning Board.
Note: this approval shall expire I 8 months from the issuance date unless all conditions have been complied
with and a building permit issued.
