Application Narrative
80 W Cir LLC
Application for Special Use Permit
80 W Cir LLC (the “Applicant”) submits this Application for a Special Use Permit, dated
June 23, 2023. Applicant is the owner of the parcel located at 80 West Circular Street, Saratoga
Springs, New York, with Tax Map No. 165.82-2-46 (the “Project Site”). The uses permitted at
the Project Site are limited to those provided in the UR-3 zoning district. Applicant seeks
designation of the Project Site as a Neighborhood Commercial Establishment and seeks approval
for a special use permit to permit a retail goods establishment use of the space within the existing
structures (the “Project”).
The structure at the Project Site was historically a train depot or freight house that
serviced the D&H Railroad Corporation from approximately 1915 to 1958. The 14,000 ± square
foot train depot contains 8 “Suites” each accessed by means of a separate large bay door together
with a tattoo parlor existing along the frontage on West Circular Street. A southerly portion of
the structure was also utilized by NAPA Auto Parts, subject to a separate application for a retail
special use permit. Due to its unique nature and historical use, Applicant believes the Project
Site is best utilized in a commercial manner. In an effort to seek long term retail lessees of the
Project Site, it must be properly zoned for retail so that it can be marketed and viewed.
Granting the special use permit will not adversely affect surrounding properties or the
character of the neighborhood. Applicant seeks to rejuvenate the site by renovating the building
to make it more attractive for retail purposes. Through its Project, Applicant can remain
competitive in the leasing market, something it has been unable to do with the restrictions of the
UR-3 zoning district and limitations and layout of the commercial building. The intent of the
UR-3 zone is to accommodate nonresidential uses that are compatible with the district or
neighborhood. The redevelopment of the Project site accomplishes this intent. The
redevelopment continues to use the building that has been in the community for approximately
108 years. The Project Site is surrounded by dense residential uses, including an apartment
