In reference to 632 Broadway Application

The new plan is in the right direction, we still have a few concerns,
A. The first plan showed the pool equipment in the center of the lot from the garage to the lot line. The second plan showed it to the right next to the garage.The third plan shows it moved to the far left of the lot enclosed in a fence.
All plan placements are only feet from our living room door and master bedroom window. It is our understanding that pool equipment needs to run continually 8 to 10 hours a day.
What if the sound from the placement of pool equipment is above noise level standards for unreasonable noise. The city code § 148-3. Standards for unreasonable noise.The standards which may be considered in determining whether a violation of this chapterexists may include but not be limited to the following:A. The level or volume of the noise.B. The time of day or night the noise occurs.C. The duration of the noise.D. Whether the noise is recurrent, intermittent or constant.E. Whether the making of the noise is reasonably necessary for the protection or preservation of property or of the health, safety and welfare of a person or persons.F. Whether the noise is reasonably necessary for temporary building or construction operations.G. Whether reasonable methods are available for deadening or muffling the noise.H. The proximity of the noise to residential property or property customarily used by persons for sleeping.
B. Proposed vegetation screening/buffering. (Plan says exact species to be determined)What species are they going to be and how tall and who decides that.
C. The existing hedge row along Ambrosino property line is still in question, we are in the process of getting a new survey to help determine the location.
D. The proposed retaining wall and 6 ft solid panel privacy fence. We would be interested in seeing an elevation, meaning is it going to be level the whole length of the fence from garage to lot line? What is the proposed retaining wall material going to be?
