HomeMy WebLinkAbout20230396 402 Lake Area Variance Extension ApplicationJune 6, 2023 Mr. Gage Simpson, Chair Zoning Board of Appeals City of Saratoga Springs 474 Broadway Saratoga Springs, New York 12866 Chairman Simpson and Members of the ZBA, In September 2020, Stewart's Shops submitted an Area Variance request to the Zoning Board of Appeals (ZBA) for the redevelopment of our store at 402 Lake Avenue, In July of 2021, a Negative Declaration as issued by the Planni wng Board, acting as SEQRA Lead Agency. The emphasis for the Negative Declaration was a commitment by Stewart's to install a fourth segment to the signalized intersection at Weibel Avenue and Lake Avenue which will serve as a private driveway. On September 27t" 2021, the ZBA issued a positive determination regarding the application of Stewart's and Stewart's ultimately went on to achieve Site Plan approval from the Planning Board in August of 2022 and a revision of October 2022. In December 2021, I was appointed to fill a vacancy on the Planning Board while the application pending. This matters because in accordance with the "Disclosure" section on Page 8 of the ZBA application, I am writing to disclose my relationship to this application as a City Officer. Consistent with Section 13 of the City Code (Ethics), I have recused myself during the Planning Board's deliberation on the application. Stewart's was unaware the Building Permit note said "unless any necessary building permit has been issued and actual work begun," and, on June 1St Stewart's was informed that the eighteen (18) month period for validity of the variances has ceased. This was done despite the Building Permit submission on March 9t" and variances coming due March 28t". Because the variance lapsed while permit pending, Stewart's was directed to submit an application for Extension, which is enclosed. In addition to this, Stewart's had to wait for several items from the City of Saratoga Springs including the supporting information for the Letter of Credit. When requesting an extension of time for an existing variance, the applicant must prove that the circumstances upon which the original variance was granted have not changed. Specifically demonstrate that there have been no significant changes on the site, in the neighborhood, or within the circumstances upon which the original variance was granted: The store has been operational since 1990 and is now an institution on this side of the City. When the variances were granted the lack of impact on the neighborhood were cited.
