SARATOGA SPRINGS, NY I 2866 Involving the premises at 22 I West Circular Street, with tax parcel #I 65.73-2-47, in the City of Saratoga Springs, on an application for a permanent special use permit for a proposed Neighborhood Commercial Establishment in the Urban Residential—2 (UR-2) District. In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II action: (c)(I 8) reuse of a residential or commercial structure, or of a structure containing mixed residential and commercial uses, where the residential or commercial use is a permitted use under the applicable zoning law or ordinance, including permitted by special use permit, and the action does not meet or exceeds any of the thresholds in section 6 I 7.4 of this Part; Therefore, no further review is required; Having properly noticed and conducted a public hearing on May I I, 2023 as required on the proposed use; And, upon evaluation of the application based on the City's enumerated criteria to ensure that the proposed use(s)will not adversely affect surrounding properties and community character; And, in accordance with the standards set forth in the City's Unified Development Ordinance, article I 3.4 "Special Use",the Planning Board issues the following decision on May I I, 2023 (passed 6-0—in favor: Torpey, Pingel, Fabozzi, Mayo, McTygue, Morrison): C� Issue a permanent special use permit for a nei�hborhood commercial establishment—�enerally consistent with the dia�ram submitted May I 0, 2023 -with waiver of site plan review upon satisfaction of the followin�conditions: Conditions: I. The applicant shall submit a plan to improve fencing along the east and north property lines—such plan will be reviewed by the Chair under administrative action authority. 2. The applicant shall install a detectable texture warning strip to the sidewalk that connects to Benedict St. 3. The applicant shall install a total of four street trees along W. Circular St. upon satisfaction of the City Arborist of locations and species. The existing Norway Maple could be maintained to satisfy one of the trees required in the treebelt. 4. The Board notes that the applicant conceded abandonment of the Use Variance granted in I 994 for"rental center with associated retail sale and outdoor display space"and shall provide correspondence stating such Page I of 2 to be reviewed by the City's legal counsel and the Chair.
