The development would include relocating the existing main and carriage house onto its own parcel and redeveloping them into a total of 8 condominiums and on a separate parcel the construction of four (4) 3,623 s.f. three-story apartments with 9 units in each, resulting in 36 total units. The parcel is located along Excelsior Avenue with two existing access entrances. It is proposed that access to both the relocated structures and the apartments will come via Excelsior Springs. The parcel is currently serviced by public water and public sewer from the City of Saratoga Water System and Saratoga County Sewer District. All improvements proposed shall be owned and operated by the landowner with nothing being conveyed to the City of Saratoga Springs. The parcel is located within the UR-4 Urban Residential zoning district. Multi-Family residential developments are permitted as of right within the UR-4 district. As shown on the zoning map below, the project site is adjacent to the 182 Excelsior Avenue Apartments May 3, 2023 Page 2 of 5 Urban Neighborhood District (UN), Neighborhood Center District (NC), Institutional Education District (INST-ED) and Urban Residential 1 District (UR-1) Districts. \ 3.0 INFRASTRUCTURE 3.1 Roadways and Site Access The existing parcel is provided access to a public right-of-way (Excelsior Avenue) via existing access points that directly enter Excelsior Avenue. The proposed site development will include two entrances on Excelsior Springs to eliminate the concern of the Planning Board of traffic entering Excelsior Avenue at Veteran’s Way. The relocated structures will be located on a proposed lot along Excelsior Avenue with the entrance approximately 100 feet south of the intersection with Excelsior Avenue. The proposed apartment lot entrance will be approximately 200 feet south of the intersection with Excelsior Avenue. We are proposing over the minimum parking spaces per unit (Code 1.5 spaces per unit) based on past experiences of similar uses. The parking areas propose to contain approximately a total of 66 parking stalls (5 ADA accessible parking stalls) for both the condominiums and tenants of the apartment units. 3.2 Traffic – ITE Generation The trip generation analysis was completed using the Institute of Transportation Engineers (ITE) Trip Generation Manual, 11th Edition to determine the peak hour vehicle trips associated with the project. Land Use Code (LUC) 220, Multifamily Housing was utilized for existing and proposed conditions. Below is a summary of the peak hour vehicle trips generated from the project. 182 Excelsior Avenue Apartments May 3, 2023 Page 3 of 5 Trip Generation - 182 Excelsior Avenue AM Peak PM Peak Entering Exiting Total Entering Exiting Total Existing Apartment Trips (10-units) 1 3 4 3 2 5 Proposed Condo/Apartment Trips (44-units) 4 13 17 15 7 22 Difference (34-units) 3 10 13 12 5 17 · The AM and PM peak hour vehicle trips for the project are 17 and 22 respectively. · When accounting for the existing apartments on site, the difference in AM and PM peak hour vehicle trips would be 13 and 17 respectively above the current use. 3.3 Potable Water The existing parcel is within the City of Saratoga Springs Water District and an individual water service connection extending from a Town water main currently exists. As part of the project, a new water service will be necessary based upon project demands. Based upon the proposed use, the average day water demand is expected to be 9,680 gallons per day. NYSDEC Design Standards for Intermediate Sized Water Treatment Systems dated 3/5/2014 was used to determine anticipated flow rate, (44 units X 2 bedrooms per apartment X 110 gpd/bedroom). 3.4 Sewage Disposal The existing parcel is within Saratoga County Sewer District No.1 and an individual sewer service connection extending from a county sewer main within the public right of way currently exists. As part of the project, the existing sewer lateral can possibly be reused for the relocated structures. A second low pressure lateral would be installed for the apartment buildings. It is anticipated that two buildings would each connect to an E-One quad station which would discharge to the County system. Based upon the proposed use, the average day sewage generation is expected to be 9,680 gallons per day. 3.5 Stormwater Management The project will disturb more than 1 acre of land. As such, it will be subject to the NYSDEC General Permit GP-0- 20-001. The project design will follow the requirements of Chapter 9 of the NYSDEC Design Manual and is defined as a redevelopment project with an increase in impervious area. A project specific Stormwater Pollution Prevention Plan (SWPPP) will be prepared as part of subsequent project submissions. 3.6 Wetlands A wetland delineation was performed on site on September 7, 2022. One small area, 724 sf was delineated on the northwest corner of the parcel. The delineation was submitted to NYSDEC for their review as the parcel is located within the NYSDEC 500’ check zone. See correspondence dated September 16, 2022, from NYSDEC validating the delineated wetlands as well as indicated they will not take jurisdiction over the wetlands on the site. The Army Corps of Engineers has also reviewed the wetlands and provided a jurisdictional determination. The wetland on site “Wetland A” was determined to be non-jurisdictional and only the off-site Spring Run stream was considered part of a tributary system. 182 Excelsior Avenue Apartments May 3, 2023 Page 4 of 5 3.7 Archaeological/Cultural Resources M.J. reviewed New York State’s Office of Parks, Recreation, and Historic Preservation’s online Cultural Resource Information System (CRIS) for this site and verified that the site was located within an archeological sensitive Area. Phase 1A/B Archaeological Survey report was prepared by Curtin Archaeological Consulting, Inc. in January 2023. We received correspondence from the NYS Office of Parks, recreation and Historic Preservation concurring that the materials recovered do not represent an intact archaeological site and no additional archaeological work is necessary resulting in the project having no effect on archaeological resources. It is proposed to preserve the existing main home and carriage barn by relocating them on the property closer to Excelsior Avenue as they once were back in the earlier 1900’s prior to Excelsior Avenue being relocated. 3.8 Soils Review of the National Resources Conservation Service (NRCS) Soil Survey Data indicates the project area is predominately comprised of Windsor loamy sand, with the following characteristics: WnB—Windsor loamy sand · Slope: 3 to 8 percent · Depth to restrictive feature: More than 80 inches · Drainage class: Excessively drained · Runoff class: Low · Depth to water table: More than 80 inches · Frequency of flooding: None · Frequency of ponding: None · Hydrologic Soil Group: A A geotechnical Engineering Report was provided by Daniel G. Loucks, PE on August 22, 2022. His testing consisted of six (6) soil borings throughout the upper portion of the parcel. All of the borings encountered fill materials from 0-8’ below the existing surface. The report states that the fill encountered is “…generally sand with a trace to some silt and gravel. The borings were stopped at 17’; none of which encountered refusal or bedrock. The groundwater table encountered at these borings was located below a depth of 4 feet. 4.0 AREA VARIANCE Variance Lot 1 – Proposed four 9-unit apartment buildings (36 units total) on an 80,239 sf parcel. Therefore, based upon the above information the project proposes the following variance for this project. 1. Article 3.3, Table 3-A: Residential Districts Dimensional Standards a. Minimum Lot Area, Residential of 3,000sf/dwelling unit to 2,229sf/dwelling unit 5.0 STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQRA) Based upon the scope of the proposed project, it is believed to be an Unlisted SEQRA action. It is believed that over the course of the project’s review, adequate information will be provided to potentially support the issuance of a negative declaration by the Lead Agency under SEQRA. 182 Excelsior Avenue Apartments May 3, 2023 Page 5 of 5 6.0 PERMITS / APPROVALS Based upon the conceptual plan developed, it is believed that the regulatory approvals that would be necessary are as follows: · City of Saratoga Springs Zoning board of Appeals: Aea Variance. · City of Saratoga Springs Planning Board: Site Plan approval. · Saratoga County Planning Board: Referral · City of Saratoga Springs Waters Department: Water Permit · Saratoga County Sewer District No.1: Sewer Permit. · NYSDEC Stormwater Permit Coverage Other agencies having jurisdiction may be identified over the course of the project’s review. We have reviewed the submitted materials in accordance with the New York State Historic Preservation Act of 1980 (section 14.09 of the New York Parks, Recreation and Historic Preservation Law). These comments are those of the Division for Historic Preservation and relate only to Historic/Cultural resources. The Archaeology Unit has reviewed the Phase I Archaeological Survey report prepared for this project (23SR00104; January 2023). Based on the report findings, it is OPRHP’s opinion that the materials recovered from the project area do not represent an intact archaeological site. We concur with the report recommendation that no additional archaeological work is necessary. Please note that these comments pertain only to archaeological resources.
