NOTICE OF DECISION
In the matter of the application - #20230008
Munter Land Holdings, LLC
Duplainville Road
Saratoga Springs, NY I 2866
Involving the premises with tax parcel no. I 77.-7-67 in the City of Saratoga Springs, on applications for site plan
review and land disturbance activity permit for a proposed 45,480 sq. ft. flex commercial warehouse with
corporate office and 25,000 sq. ft. accessory building and associated site work in the Industrial -General (IND—
G) district.
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as Type I and issued a Negative
SEQRA Declaration on March 23, 2023;
Upon fulfilling the requirements of"Posted Notice" in I 3.3 of the UDO, the applicant presented proposed
revisions to the site plan at the April 27 meeting;
On April 27, 2023, the Planning Board made a finding that no new or different impacts would likely result by the
site plan changes;
On April 27, 2023, the Planning Board rescinded the prior approvals granted on March 23, 2023;
And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance,Article
I 3.5, the Planning Board issued the following decision on April 27, 2023 passed 7-0 in favor: Torpey, Pingel,
Fabozzi, Mayo, Marshall, McTygue, Morrison:
C� Approve land disturbance activity permit and site plan set(with revision date I 2/I 6/2022)—further modifications
to the site plan set include resubmitted site and utility plan sheet(revised 4/24/23), and plantin�plan sheet(revised
4/25/23), with the followin�conditions:
I. Vegetative buffering shall be installed along the front property line (adjacent to Adams Rd.)
extending 50 ft. into the property per planting plan (rev. 4/25/23).
2. Vegetative buffering shall be installed along the west side property line (adjacent to the
residential district) in accordance with the interior side setback yard requirements per I I.7 A.
of the U DO.
3. Existing vegetation along Adams Rd., a designated rural road corridor, adjacent to the front
property line shall be maintained as a no-cut buffer of approx. I 5 ft.
4. A no-cut buffer note shall be added to the final plan set stating that the vegetative buffer areas
(to be installed)will be maintained as approved and will not be clearing or disturbed.

5. Significant land clearing is required to accommodate the commercial operations of the new
company moving to the industrial park. The Planning Board discussed at great length the
community benefit associated with preserving trees throughout the city's urban forest and the
applicant volunteered to coordinate with the Planning Department to mitigate the land
disturbance. An opportunity will be pursued with the SoBro Conservancy to assist in the re-
greening of a vacant parcel that was once the site of an old gas station.
6. Stacking of product in the outdoor storage yard shall not exceed 30 ft. high.
7. The applicant shall install a max. 8 ft. high wood stockade fence with sound attenuation in
accordance with the revised planting plan and fence detail.
8. Final plans shall be provided to the satisfaction of the City's designated engineer and DPW.
The applicant is required to:
I. Provide documentation of conformance with all required conditions of approval.
2. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the
City. This must occur prior to final signature by the Planning Board Chair.
3. Submit two (2) paper copies and one (I) electronic copy of the final approved site plan set for
signature by the Planning Board Chair within ei hteen (I 8) months of approval as per Article I 3.5
of the Unified Development Ordinance.
Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not
started actual construction as per Article I 3.5 of the U DO.
