Comments At the September 26, 2022 ZBA meeting Stewart’s was
directed by the City planning department staff to address the
questions raised about Zoning Ordinance Sect 6.3.3 B-3
regarding the property line associated with the gas station
under the current proposal.

Aneisha Samuels, Senior Planner, stated since the lots have
just been consolidated staff would need a narrative explaining
this.
Ms. Coreno stated she will providing this to staff.

However, in their letter to the ZBA dated December 2, 2022
Stewart’s completely fails to address the question about
property lines associated with the gas station, at all.
Rather, they make reference only to the placement of gas
pumps, and incorrectly quote section 6.6.3, confounding ZO
Sect 6.3.3-A with 6.3.3-B-3, which speaks to the property line
associated with the gas station with respect to an abutting
residential district.
As a lot line different than the one that is currently associated
with the existing gas station would make the project as

proposed diallowed under the Zoning Ordinance, it is our belief
that until such time that this question is resolved, no further
action by the ZBA on the merits of any area variance request
should be considered.
If and when Stewart's seeks to address the quesion about lot
lines associated with a gas station, as it is defined in the zoning
ordinance, the Maple Ave, Marion Ave, Maple Dell
Neighborhood Association will be prepared to provide further
commentary. We respectfully request the opportunity to do so
at the approporiate time.
