from the determination of the Building Inspector involving the premises at 110-114 Nelson Avenue Lot 1 in the
City of Saratoga Springs,New York being tax parcel number 166.77.47-17 on the Assessment Map of said City.
The applicants having applied for an area variance under the Zoning Ordinance of said City to permit the
construction of a new residence and detached garage in a UR-2 District and public notice having been duly given
of a hearing on said application held January 23 through March 13,2023.
In consideration of the balance between benefit to the applicants with detriment to the health,safety and welfare of
the community, I move that the following area variances for the following amounts of relief:

As per the submitted revised plans at the meeting,dated March 13,2023 or lesser dimensions,be approved for
the following reasons:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant.
The applicant submitted that the vernacular architecture of the surrounding residences in the neighborhood
along with the setbacks of those residences are consistent with the requested variances for the proposed
new construction. The proposed residence was designed to accommodate the needs of the applicant,as
well as to blend with the architectural details of historic homes in the surrounding neighborhood, according
to the applicant. Based on these characteristics and unique location of the property,the Board finds that
the applicant has demonstrated that other alternative designs that were considered would not serve the
applicant or the neighborhood as well as the proposed design.
2. The applicant has demonstrated that granting this variance will not create an undesirable change in
neighborhood character or detriment to nearby properties. The applicant has provided evidence,including
video and written materials,which the Board finds establish that the variances are similar in context to
neighboring properties.
3. The Board finds these variances substantial,but notes the character of the neighborhood mitigate this
concern as the proposed design and setbacks are similar to other residences.
4. These variances will not have significant adverse physical or environmental effect on the neighborhood or
district.The lot will exceed permeability requirements of 25%.

5. The alleged difficulty is self-created insofar as the applicants desire to construct the proposed addition,but
this is not necessarily fatal to the application.
Condition: the Applicant is required to submit revised plans reflective of the relief granted.
It is so moved.

This variance shall expire 18 months following the filing date of such decision unless the
necessary building permit has been issued and actual construction begun as per the Unified
Development Ordinance.

Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, five
members of the Board being present.
