The City of Saratoga Springs Zoning Ordinance has always had provisions for dealing with lots that are divided
by the boundary between two or more zoning districts.
The two parcels in question known as 31 and 33 Marion Ave have been historically zoned as follows:
Prior to 1961: Zone D – Unrestricted except for any Business, Trade, or Use that may become a nuisance
1961: Prior to Arterial, road configuration was different. On the east side of Marion Ave, Directly Across from
Avenue C, the zoning district was split. To the south it was Light Industry. To the north it was Residential 2
(Single Family).
1971: Arterial had been constructed using former S&W railroad right-of-way. Avenue B&C were reconfigured.
Avenue B is a “paper street”.
R-2 Zoning District is roughly aligned with the southern boundary of Avenue B. South of dividing line is B-3
Planned Business abutting Marion Ave. North is Light Industrial for the section that had Congress Gas and Oil
1984: The line of the split between R-2 and B-3/I-1 might have shifted slightly South, but the districts are the
same as 1971
Proposed legislation in 1989 - 1990 to change all parcels on the east side of Marion Ave between the Arterial
and the Town of Wilton to “Conservancy” was defeated. It also received a “Disapproved” notice from the
County Planning Board, Chairman – William P. Dake. In the same opinion, they also recommended that B-3 for
all the parcels was inappropriate due to increased traffic pressure on Marion Ave. They recommended a PUD.
Confirmation of the exact location of the zoning district split can be found in the Planning Department files for
the interim zoning around Loughberry Lake.
10/15/1990: The industrial zone is gone. Avenue B is gone from the map. Split between UR-2 and Commercial
– 3 is approximately 550 feet north of Marion Ave intersection with Rt. 50. C-3 zone is approx. 150 feet deep
from Marion Ave ROW.
1/7/91 Major Map Updates
Zone 2 Inner – District boundary roughly the same shape as 1990, still UR-2 and C-3, but the C-3 portion is
actually dimensioned. 440’ long from Marion Ave / Rt. 50 intersection, 200’ deep from Marion Ave ROW
12/2/91 Map Amendment – Hatch patterns have changed, but zones and dimensions are the same as 1/7/91
1993 Map Update – Apparently there were no updates to this map panel and it was not republished
Apparently the same for 1995 and 1996 updates – confirmed with later map packages
Entirely new mapping began in 1997, published date is usually 4/1/98 – first map sections with parcel
boundary level detail
1998 – The split between UR-2 and C-3 coincides with the property boundary of the two parcels in question.
Still approximately 440’ north of Marion / Rt.50 intersection. Does not appear to be as deep. Looks to be
shortened in order to coincide with parcel boundary at north side of National Grid power line parcels
1999 – Comp Plan changes. The area identified as C-3 changes to TRBD on the southern parcel, but the
boundary between UR-2 and TRBD (7/28/99) is exactly the same as UR-2 and C-3 (7/13/99).
Other areas of C-3 did change to some of the new “Impact Districts” or “Special Development Districts”
5/20/03 – First map showing Transect Districts. Boundary line was still the same between UR-2 and TRBD
2012 – With the 2012 Zoning Ordinance revision, the name of the district changed from Tourist Related
Business District (TRBD) to Tourist Related Business (TRB). The district boundary stayed in exactly the same
place (on the parcel line separating the two parcels in question).
2017 – Parcels, Districts, Boundaries unchanged
December 2019 – The adjacent parcel (towards Loughberry Lake) that had been acquired by the City was
changed from UR-2 to INST-PR. The Parcels, Districts, and Boundaries in question were unchanged.
UDO 2022 – The TRB parcels are changed to GC-U, with exactly the same boundaries. Two of the UR-2 parcels
near the lake are changed to RR.
So ever since the Zoning Map has had parcel level detail in 1998 (and arguably back to 1991) the dividing line
between UR-2 and the commercial zone has been in exactly the same place. C-3 changed to TRBD in 1999 and
it has been TRBD / TRB ever since.
Since 1991, the commercial zone has been roughly confined to 440’ north of the intersection of Marion Ave
and Rt.50, and bound on the East by the former HVRR / Mt. McGregor railroad
