I 66.30-I-3 in the City of Saratoga Springs, on an application for site plan review for a proposed I 02-unit multi-family residential project and associated site work in the Transect—5 district. The Planning Board issued a Negative SEQRA Declaration on November I 7, 2022. The Planning Board issued a Special Use Permit on February 9, 2023. And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter 240, article 7.2 "Site Plan Review",the Planning Board issued the following decision on February 23, 2023 (passed 5-0-I(Marshall recused) in favor: Torpey, Pingel, Fabozzi, McTygue, Morrison): C� Approve site plan set with revision date December 5, 2022 with the followin�conditions: I. The Board notes the applicants offer to maintain 20%of the total units as affordable (up to 80%AMI) for a term of I 5 years. The applicant agreed to provide an annual report documenting compliance to the Planning Dept. 2. The applicant shall provide a public access easement for the portion of the civic space located on private property. The easement language shall be to the satisfaction of City legal counsel. 3. The applicant shall provide a cash escrow to the City($72,000)toward traffic mitigation improvements at the intersection of Excelsior Ave. and Marion Ave. as identified in the SEQRA Amended Findings Statement for Excelsior Park. The agreement language shall be to the satisfaction of City legal counsel. 4. An approximate 75-feet of existing vegetation along the east side of the property shall be identified as a no-cut buffer area on the site plan. A note referencing the Board's Conservation Area and No Cut Buffer Policy shall be added to the site plan. 5. On the west side of the property, there shall be no tree clearing within the NYS DOT drainage easement area except as authorized by DOT in accordance with their drainage easement for the purpose of constructing, reconstructing and maintaining berms, a drainage pipeline, and a stream channel. 6. The City shall be provided access through the property as needed to repair/maintain the Loughberry Lake d am. 7. Final plans shall be provided to the satisfaction of the City's designated engineer and the City Engineer's Office (DPW). 8. The applicant shall provide a fee in lieu of dedication of recreation lands for each residential unit ($2,000 for each unit). Page I of 2 The applicant is required to: I. Provide documentation of conformance with all required conditions of approval. 2. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the City. This must occur prior to final signature by the Planning Board Chair. 3. Submit one (I) mylar and two (2) paper copies of the final approved site plan set for signature by the Planning Board Chair within ei�hteen ,I 8� months of approval as per Article 7.2.I 2 of the Zoning Ordinance. Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not started actual construction as per Article 7.2.I 4 of the Zoning Ordinance.
