MEYER, FULLER & STOCKWELL ..4440 LAKE GEORGE RLLO ATTORNEYS AT LAW TITLE AGENCY June 28, 2019 City of Saratoga Springs, Zoning Board of Appeals City Hall 474 Broadway Saratoga Springs, NY 12866 Re: Appeal by Quinn Borchardt Brewing, LLC d/b/a Artisanal Brew Works Property at 41 Geyser Road, Saratoga Springs, NY; TMP 178-1-33 Dear City of Saratoga Springs Zoning Board of Appeals: Following up on the June 17, 2019 ZBA meeting, I have had the chance to review the Jun 10, 2019 letter from Assistant Building Inspector Patrick Cogan. At the outset, I will formally note that any correspondence in this matter from the City that is not copied to my office or my clients violates their rights to due process. We cannot be expected to respond, as the appellants, to papers not copied to us. That said, we appreciate the acknowledgment that the brewery, bottling/canning operation, and tasting room are not at issue in this appeal. In addition, we appreciate the clarification that all sales of beer, bulk, wholesale, retail, tastings, etc. produced by Artisinal Brew Works are regulated by SLA and are not limited by the zoning determination. In addition, we also acknowledge and accept that the uses permitted under my clients' SLA license is also allowed as per Mr. Cogan's letter. To that end, I am providing herewith the authorization and approval from SLA for the outdoor seating areas. We consider this included in his letter. However, contrary to Mr. Cogan's letter, I submit to the ZBA that it is NOT reasonable to expect my clients to file for a zoning request for every item that they ever expect to sell. Indeed, I would invite the ZBA to point to ANY industry or business in the City of Saratoga Springs where the City actually peers into the business' actual sales to determine what is and is not licensed. Indeed, I believe that would be unconstitutional. There is no reasonable interpretation of the City's Zoning, or indeed even the City's police power, that would permit, for example, the 1557 STATE RT 9, LAKE GEORGE, NY 12845 Phone: 518-668-219 9 www, & er fu/i icor Page 12 City to say whether or not Artisanal Brew Works could sell, hats, or t-shirts, or glassware, etc., none of which is discussed in Mr. Cogan's letter. It appears from the remainder of Mr. Cogan's letter is that my clients are being given conflicting direction from different agencies within the City as to what they can and cannot do. Indeed, for special events, they are advised to apply for certain types of licenses so that their events do not trigger other sorts of licenses. That is not an issue for my clients, it is an issue for the City to resolve. Indeed, in reviewing the letter of June 17, 2019, as opposed to the various emails in the record that I have submitted, and the conversations my clients have had with City staff, there appears to be some sort of internal conflict between departments here, and my clients are caught in the middle. To say that my clients did not seek City approvals as to their uses is patently false. My clients met on countless occasions with City personnel. What happened here is that upon a letter writing campaign, new decisions have been rendered as to my clients' allowed uses. As to the building permits, if you review the permits, they were for plumbing and related improvements. The building permits have absolutely nothing to do with the zoning determination here. That is often the issue when an individual is a building inspector and also the zoning administrator. I too have often experienced this confusion. Building codes issues are often considered in the context of zoning determinations, and the two are mutually exclusive and have no connection or bearing on one another. As such, any discussion on building permits is irrelevant. The remainder of the appeal stands as written. The ancillary uses of allowing internal limited food sales- not a complete kitchen, but limited sales, indoor music, etc. all seem here to be ancillary, to the point that perhaps Mr. Cogan's letter now authorizes my clients' use. We are unsure if the exact determination set forth in his letter. Lastly, if needed, my clients will stand ready, willing and able to prove their investment in this property. Mr. Cogan has absolutely zero basis to render any opinion or determination on my clients' business or their investment in this location.
