Subdivision, Ms. Eberlein, had not complied with: • the Planning Board Subdivision 2020 Requirements for 44 Ruggles Rd, • the City’s Conservation Policy, and • the Subdivision Declaration of Restrictive Covenants. As stated in the March 17, 2022, STOP WORK ORDER: “Applicant failure to delineate no- cut buffers and conservation areas prior to clearing, cutting, site work, and construction in accordance with the Planning Board' s Notice of Decision.” On March 17, 2022, conservation areas were not delineated. The conservation areas for the 42 Ruggles Rd Subdivision were discussed in the 2019 Planning Board meeting per the minutes: From the May 19, 2019, PB Meeting Re Conservation Area Mark Torpey, Chairman questioned how to properly delineate the conservation area. The agent’s applicant stated the deed and Covenance are filed with the County Clerk’s office with the plat. We are proposing standard no cut buffer signage and are proposing six signs noting the location for the Board. Mark Torpey, Chairman spoke regarding the signage and labeling and what is proposed in perpetuity. Approval for this could be a contingency if we move this application forward this evening. Also how the rural integrity of Ruggles Road is being preserved in terms of buffering. From the December 12, 2019, PB Meeting Re Conservation Area Todd Fabozzi questioned the conservation area and how will it be buffered and denoted. Mr. Ingles stated over half the area will be preserved. The applicant will provide signage so it will remain for perpetuity. Ms. Eberlein only put up the required Conservation Signage in May 2022. The required signage was based on the 2020 Planning Board’s Notice of Decision. Since the current owner has failed to comply with these requirements in the past it should be required that the city verify compliance in the future.
