Attached is our Designated Engineer's Workscope for Escrow along with City's Escrow Agreement.
Please forward to the Applicant and have them post funds and return the signed Agreement for a total of
$3,850.00. As always, any unused funds will be returned to the Applicant.
Once these documents are received, the City will issue a PO and will direct our Designated Engineer to
begin review. Please work directly with the Designated Engineer (LaBella) and City Engineer Technician
(Al Flick). Any revised items that need to be resubmitted, can be sent directly to (LaBella) and to the
Planning Department.
"All submittals for this project, including As-Builts, shall be sent directly to Planning Department.
Planning Department will distribute to internal departments"

CASH ESCROW ACCOUNT DECLARATION
FOR CITY ENGINEERING CONSULTANT REVIEW EXPENDITURES FOR
126 West Avenue
THIS DECLARATION, made on the 27th of September 2022, by
B & D Properties, LLCI (hereinafter "the Applicant/Property Owners"), for the benefit of the
City of Saratoga Springs, New York, having an address for transaction of business at City Hall,
474 Broadway Saratoga Springs, New York 12866 (the "City").
WHEREAS, the Applicant/Property Owners have submitted to the Planning Board of the
City, an application for site plan/subdivision review for a project known as;
"126 West Avenue Proiect"
and
WHEREAS, the City has contracted with LaBella (the "Contractor") for technical
review services; and
NOW, THEREFORE, the Applicant/Property Owners hereby and herewith pledge to post an
additional amount equal to $ 3,850.00 with the Commissioner of Finance of the City of
Saratoga Springs in order to cover the City's costs for technical review of the
site plan/subdivision drawings.
All funds deposited hereunder shall be placed in a separate and distinct account.
The City is authorized to withdraw any amount necessary, up to the total amount on
deposit with the City, in order to pay for the costs associated with the technical review of the
site plan/subdivision drawings. The Contractor shall provide the Applicant/Property Owners
copies of all invoices and an accounting of charges and services of all withdrawals from the
escrow account.
In the event the City shall draw funds under this Declaration for the stated purposes and
there is any surplus held by the City upon completion of project review, then the City shall
refund said surplus to the Applicant/Property Owners.

Dear Michael:
LaBella Associates (LaBella) are pleased to submit our estimate of funds that should be placed into
escrow for the review of the following materials:
® Application for Site Plan Review dated October 22, 2021, including Site Plan Review
Submittal Checklist and Land Use Board Fee Worksheet,
® Short Environmental Assessment Form signed by Joseph Hens, dated February 1, 2022,
® Stormwater Pollution Prevention Plan prepared by Ingalls, dated October 18, 2021 and
revised January 17, 2022.
® New Water Service Connection Agreement and Application Form signed by David F. Ingalls,
dated October 22, 2021, and
® Site Plans entitled "West Ave Mixed Use Development" prepared by Ingalls unless otherwise
noted below, dated October 19, 2021, consisting of the following sheets:
0 1 - Cover Sheet
0 2 - Existing Conditions
0 3 - Site Plan
0 4 - Grading & Utility Plan
0 5 - ESC Plan
0 6 - Details
The Applicant has applied for a Special Use Permit and area variance for the project, which was
granted by resolution by the Zoning Board of Appeals on July 25, 2022. The Applicant does not
appear to have submitted a Complete Streets Checklist, Cost Estimate for Letter of Credit, or
Engineering Report. We assume these documents will be required bythe City and will be submitted
prior to the initial site plan review.
Based on the information provided, we believe the escrow should be initially funded with $3,500 to
cover the expenses associated with the review of the referenced documents. The estimated amount
is envisioned to cover the cost associated with reviewing the referenced documents, preparing a letter

summarizing the findings of our review, and two subsequent reviews of revised documents and a point
by point response letter that describes how our comments were/were not integrated.
We will schedule staff to begin reviewing the material described above the first Monday after the
escrow is funded and we receive authorization to proceed, and we expect to email our review letter to
you for comment within two weeks of that Monday.
Fee Schedule
LaBella will provide all services on a "Time -and -Material" basis and will issue invoices monthly for
services rendered. LaBella will make its best effort to complete this task within the estimated
amount, however fees are dependent upon the responsiveness of the applicant and their
professional consultant(s) and the effort required to provide a comprehensive evaluation as
requested by the City. We will not exceed the estimated fee amounts without written authorization
from the City. Reimbursable expenses will be invoiced and include our direct expenses, such as
mileage, overnight mailings, and extensive photocopying and map reproductions.
