NOTICE OF DECISION
In the matter of the application
#20220679

Saratoga Springs, NY I 2866
Involving the premises with tax parcel no. I 78.35-I-6 in the City of Saratoga Springs, on an application for site
plan review of a proposed multi-family residential project (58-units) and associated site work in the Transect—5
(T-5) district.
In accordance with SEQRA regulations 6 NYCRR Part 6 I 7, the Planning Board identified the proposed action as a
Type I Action, Coordinated Review, and as the designated Lead Agency for the review, evaluated the Full
Environmental Assessment Form Parts I and II, and made a motion to issue a Negative SEQRA Declaration on
September 15, 2022.
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter
240, article 7.2 `Site Plan Review',the Planning Board issued the following decision on November I 7, 2022
(passed 7-0 in favor: Torpey, Pingel, Fabozzi, Mayo, Marshall, McTygue, Morrison):
C� Motion to approve the site plan set with revision date November I 7, 2022 subject to the followin�conditions:
I. Applicant to provide and implement a plan for off-site mitigation improvements for increased pedestrian
activity associated with the project across S. Broadway at Finley St. including crosswalk and pedestrian
signage rectangular rapid-flashing beacon (RRFB). The Plannin� Board stron�ly encoura��placement of
these improvements on the south side of Finley/Adelphi Streets.
2. Applicant to provide and implement a plan for permanent protection of the existing Rosemary Spring.
3. Applicant to provide public access to the center green area including existing spring and gazebo.
Wayfinding signage per City-standard to be added at the boulevard entrance — both directional and
interpretive.
4. Public access easement to center green area/existing spring and gazebo to be granted to the City with
language approved by the City Attorney.
5. The applicant shall address any remaining technical comments from Laberge.
6. The applicant shall provide final plans to the satisfaction of DPW.
The applicant is required to:
I. Provide documentation of conformance with all required conditions of approval.
2. Submit a fee in lieu of dedication of recreation lands for each residential unit ($2,000 for each
unit).
3. Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article
7.2.I 5 of the Zoning Ordinance. This must occur prior to final signature by the Planning Board

Chair.
4. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by
the Planning Board Chair within ei�hteen (I 8) months of approval as per Article 7.2.I 2 of the
Zoning Ordinance.
Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not
started actual construction as per Article 7.2.I 4 of the Zoning Ordinance.
