The applicants having applied for an area variance under the Zoning Ordinance of said City to permit the addition of a front porch in an Urban Residential-3 (UR-3)District and public notice having been duly given of a hearing on said application held on the 27th day of June through the 28th day of November, 2022. In consideration of the balance between benefit to the applicants with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amount of relief: TYPE OF REQUIREMENT DISTRICT PROPOSED RELIEF REQUESTED REQUIREMENT MAXIMUM PRINCIPAL COVERAGE 30% 56.1% 26.1% (87%) FRONT SETBACK TO HOUSE(ALGER ST) 10, 7.1' 2.9 (29%) FRONT SETBACK TO PORCH OVERHANG ONLY(ALGER 10' 1.6' 8.4' (84%) ST) FRONT SETBACK TO PORCH WALL ONLY(ALGER ST) 10' 2.3 7.7 (77%) as per the submitted plans or lesser dimensions,be Approved for the following reasons: 1. The applicants have demonstrated this benefit cannot be achieved by other means feasible to the applicants. The property has three fronts, and the applicants desire to build a front porch facing Alger St. since that is the main entrance to the house. The Board notes there is no additional land available for purchase to alleviate any variances. This property is unique in history, as it was originally a commercial structure and as such has created undesirable hardships to convert to a single family dwelling. The setting and configuration of this lot also makes it somewhat unique and presents a unique circumstance for the Boards consideration. These considerations are not generally applicable to the other lots in the neighborhood. 2. The applicants have demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. The applicants provided neighborhood data that demonstrated the appropriateness of this addition in n this neighborhood. 3. The Board notes the requested variances of 87%, 29%, and 84% are substantial. The substantiality of the maximum principal coverage is mitigated by the previous resolution"2865 Boughton"approval of 54% coverage being increased by 2.1% on a pre-existing,non-conforming undersized lot. The 29%variance is mitigated by the house being pre-existing,non-conforming and any work done would require a variance. The 84%variance is mitigated by the neighborhood context of similar properties having comparable setbacks as mentioned in paragraph 2. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. The property will maintain a minimum permeability of 25%. 5. The alleged difficulty is considered self-created insofar as the applicants desire to build the porch. However, this is not necessarily fatal to the application. It is so moved. Grey) This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance. I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, five members of the Board being present.
