The applicant having applied for an area variance under the Unified Development Ordinance of said City to permit an addition to the existing garage within the Urban Residential 1 (UR-1) District and public notice having been duly given of a hearing on said application held on May 16th through to September 261h, 2022. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amount of relief: TYPE OF REQUIREMENT DISTRICT REQUIREMENT PROPOSED RELIEF REQUESTED Max Driveway Width Percentage 25% 72% 47 % ( 188%) as per the submitted plans or lesser dimensions,be APPROVED for the following reasons: 1. The applicants have demonstrated this benefit cannot be achieved by other means feasible to the applicants. The applicants wants to build a rear addition to the principal home and renovate the existing detached garage to include finished space. The existing lot is undersized and a standard driveway width on this lot would require relief. The Board notes that the ZBA previously granted relief regarding the modification on September 26, 2022. 2. The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. 3. The Board notes the requested variance at 188%is substantial but not necessarily detrimental to the application. The substantiality is mitigated by the points noted in 1 and 2 above. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. The Board notes that District permeability requirements will be met. 5. The alleged difficulty is considered self-created insofar as the applicant desires to construct the addition;however,this is not necessarily fatal to the application. Notes: Favorable DRC Advisory August 14, 2022 Notes: 1. The Board recommends the use of pavers for the driveway material to facilitate infiltration. 2. This variance augments but does not replace the previously granted variance dated September 26, 2022 remains in effect. It is so moved, dated: November 28th, 2022 Adopted by the following votes: AYES: 5 (G. Simpson, B. Gallagher, B. Dailey C. Grey, E. Bergmann) NAYES: 0 This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance.
