Dear Mayor Kim:
I am pleased to advise that the Planning Board voted unanimously last night on a favorable advisory
opinion on the above matter. We anticipate a written decision will be forthcoming soon. During our review of
the project with the Planning Board, some minor changes have been made which modified some of the
figures on the long environmental assessment form (EAF) originally submitted in July. For ease of review, I
have included the updated form, together with a redline type version that shows changes by highlighting the
new information in boxes. Please note that we have increased the units to 215 and have voluntarily agreed
to the conservation of 19.88 acres of land, an amount which was similar to what the project would have
conserved if a conservation analysis under the RR-1 regulations had occurred.
I am also enclosing the August 17, 2022 letter from the US Army Corps of Engineers which verifies on page
2 in the first paragraph that the wetlands on site have been delineated and consist of 9.09 acres. The
Planning Board was concerned that the autofill populated the answer on the EAF (page 11, response to
E.2.h.iv) with 20.6 acres. As you know, the autofill information comes from the DEC mapper, which is less
accurate than a site-specific delineation. This letter from ACOE confirms the wetland calculations we have
are correct and are consistent with the mapping we provided in our October 20, 2022 submission.
This hard copy of the above documents is being delivered to your office, with copies to all council members
