The applicant having applied for an area variance under the Unified Development Ordinance (UDO) of said City to permit a wall sign above first floor in the UC/T-6 District and public notice having been duly given of a hearing on said application held on the 171h day of October through the 24th day of October 2022. In consideration of the balance between benefit to the applicant with detriment to the health, safety, and welfare of the community, I move that the following area variance for the following amount of relief: TYPE OF REQUIREMENT DISTRICT PROPOSED TOTAL RELIEF REQUIREMENT REQUESTED Wall Sign above first floor Not Permitted Permitted 100%relief As per the submitted plans or lesser relief,be approved as per this Board's consideration of the following factors: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant desires to locate fabricated dimensional lettered sign above first floor, due to the building configuration and surroundings, and the uniqueness as the business is only located on the second floor. The applicant noted that the permitted dimensions do not provide sufficient visibility to their business location for customers and provided neighborhood context of other business signs above the first floor. 2. The applicant has demonstrated that granting these variances will not create an undesirable change in neighborhood character or detriment to nearby properties. Per the applicant, the proposed sign will not be illuminated, and will not impose upon any of the neighboring properties. The Board notes the applicant also provided other options but noted which one they believed would be optimal for their business. 3. The Board notes the requested variance is substantial. However, the Board notes that the substantiality is mitigated by its low impact on the neighboring properties, as noted above. 4. The applicant has demonstrated this variance will not have an adverse physical or environmental effect on the neighborhood; as noted above. 5. The alleged difficulty is considered self-created insofar as the applicant desires to install a sign above the first floor. However, this is not necessarily fatal to the application.
