I 66.-3-30 in the City of Saratoga Springs, on an application for site plan review of a proposed new 4,000 sq. ft. convenience store,gasoline pumps, and associated site work in the Rural Residential (RR) district. In accordance with SEQRA regulations 6 NYCRR Part 617, the Planning Board identified the proposed action as an Unlisted Action, Coordinated Review, and as the designated Lead Agency for the review, evaluated the Short Environmental Assessment Form Parts I and II, and made a motion to issue a Negative SEQRA Declaration on July 29, 202 I. And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter 240, article 7.2 `Site Plan Review',the Planning Board issued the following decision on October I 3, 2022 (passed 4-0 in favor: Pingel, Fabozzi, Mayo, McTygue): C� Motion to waive the parkin� limitations to allow 22 parkin�spaces and to approve the site plan set with revision date Au�ust 29, 2022 subject to the followin�conditions: • Implementation of the landscaping plan on DOT lands within 24 months of this approval; and • Road striping to provide for a bicycle "thru lane" at the Lake Ave./Weibel Ave. intersection in the westward direction, subject to DOT approval. This condition does not require the widening of the roadway. • The applicant shall address any remaining technical comments from Barton & Loguidice. • The applicant shall provide final plans to the satisfaction of DPW. The applicant is required to: I. Provide documentation of conformance with all required conditions of approval. 2. Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article 7.2.I 5 of the Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair. 3. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by the Planning Board Chair within ei�hteen (I 8) months of approval as per Article 7.2.I 2 of the Zoning Ordinance. Page I of 2 Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not started actual construction as per Article 7.2.I 4 of the Zoning Ordinance.
