IN THE MATTER OF THE APPEAL OF

In the matter of the appeal from the Building Inspector's determination involving 815 North Broadway,
in the City of Saratoga Springs,New York,being Tax Parcel 152.-1-3 on the assessment map of said City.
The applicant having applied for an area variance under the Unified Development Ordinance (UDO) of
said City to permit an increase in the total number if signs and the relocation of an existing sign in the
INST-ED District and public notice having been duly given of a hearing on said application held on the
24th day of October 2022.
In consideration of the balance between benefit to the applicant with detriment to the health, safety, and
welfare of the community, I move that the following area variance for the following amount of relief:

As per the submitted plans or lesser relief,be approved as per this Board's consideration of the following
factors:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant.
The applicant desires to relocate an existing sign from the main entrance on the campus at North Broadway
to the entrance of the campus on Clinton Street, which will increase their total number of signs to four.
The applicant noted that other alternatives were discussed, however this option and location is the best
choice.
2. The applicant has demonstrated that granting these variances will not create an undesirable change in
neighborhood character or detriment to nearby properties. Per the applicant, the proposed sign will be
located within an existing landscape area and there are no neighboring properties near the location. The
Board notes that this property is unique due to its configuration and surroundings.
3. The Board notes the requested variance of 9.4%is not substantial. However the Number of sign request
is considered substantial. The substantiality of the number of sign request is mitigated by the use and size
of the property. The Board believes the number of signs is consistent with the property considering the
two separate entrances.
4. The applicant has demonstrated this variance will not have an adverse physical or environmental effect
on the neighborhood as noted above.
5. The alleged difficulty is considered self-created insofar as the applicant desires to relocate the existing
sign and increase the number of over all signs. However,this is not necessarily fatal to the application.

This variance shall expire 18 months following the filing date of such decision unless the
necessary building permit has been issued and actual construction begun as per 240-8.5.1.
I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the
Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, five
members of the Board being present.
