NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION
#20220339
I ZO SOUTH BROADWAY
SARATOGA SPRINGS, NY I 2866
Involving the premises with tax parcel #I 78.35-I-6, in the City of Saratoga Springs, on an application for a
permanent special use permit for a multi-family residential project (58-residential units)within the Transect—5
(T-5) District.
In accordance with SEQRA regulations 6 NYCRR Part 6 I 7, the Planning Board identified the proposed action as a
Type I Action, Coordinated Review, and as the designated Lead Agency for the review, evaluated the Full
Environmental Assessment Form Parts I and II, and made a motion to issue a Negative SEQRA Declaration on
September 15, 2022.
Having properly noticed and conducted a public hearing on September I 5, 2022 as required on the proposed
use;
And, upon evaluation of the application based on the City's enumerated criteria to ensure that the proposed
use(s)will not adversely affect surrounding properties and community character;
And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.I "Special
Use Permit",the Planning Board issues the following decision on September I 5, 2022 (passed 5-0—in favor:
Torpey, Pingel, Fabozzi, Mayo, McTygue):
C� Issued a permanent special use permit for a multi-family residential project (58-residential units).
Conditions:
I. Applicant to provide and implement a plan for off-site mitigation improvements for increased pedestrian
activity associated with the project across S. Broadway at Finley St. including crosswalk and pedestrian
signage (RRFB).
2. Further consideration of streetscape elements including placement of a triple-headed historic light fixture
at boulevard entrance to be discussed during site plan review.
3. Applicant to provide and implement a plan for permanent protection of the existing Rosemary Spring.
4. Applicant to provide public access to the courtyard area ("designated civic space to be designed that will
feature benches, bike racks, existing spring and gazebo, and open area").
5. Site plan review and approval required to implement the SUP.

Note: this approval shall expire I 8 months from the issuance date unless all conditions have been complied
with and actual work begun.
