The shed cannot be placed in between the trees(where the horse trailer is) since the shed is too wide. See photos.
Assuming the shed width would fit,the overall length of the shed is 16' and the stone ramp pad is an additional 8'.The
overall length of the shed and ramp is 24'.The ramp is needed since there is a natural slope in the yard (the rear of the
shed sits about 2' higher than the front). Assuming the shed could be moved between the trees and positioned as far
back as possible in front of the rear tree, 24'from the rear of the shed would place the front of the ramp about 5 feet
from the house, landing it onto the stone landscaping.This does not allow enough room to bring my tractor into the
shed. Also,there are low hanging power lines from the telephone pole, running to the rear corner of the home. If the
shed could be moved in between the trees,the lines sag approximately 15" lower than the roofline which would result
in the power lines sagging on the roof of the shed. I have inquired about raising the height of the power lines, which
have recently been tightened by National Grid, but the lines are placed at a lower point on the telephone pole, and it
would not be as simple as tightening the line to increase the height. Moving the shed in between the trees would not be
functional, assuming it would fit.
Pulling the shed forward from its current position:
The original chain link fence (installed before I purchased the home) ran off the rear of the home. When I installed the
new privacy fence, I followed the same footprint as the old fence and ran it off the rear of the home. I had purchased
the shed around the same time the privacy fence was installed so I did not have the option to pull the shed forward at
that time.
Summer of 2022, 1 moved the privacy fence forward, off the front of my home to add additional privacy around the
property due to the installation of the Saratoga Greenbelt Downtown Connector Trail.The sidewalk in the front of my
home was torn up and the 10'wide bike path was installed. Large trees needed to be removed to install the path,
reducing my privacy.This not only added a significant amount of foot traffic around my home, but parking also increased
tremendously along Loughberry Rd. South (on my side yard) to access the new trail and Spring Run Trail (entrance across
the street on Excelsior Springs Ave.). See photos.
With the additional space on my side yard, I have plans to build a 15'x20'garden.This would leave me with sufficient
space to access the fence gate and shed with my tractor. Moving the shed forward would sit awkward in the middle of
the property. It would not be functional and would reduce curb appeal when viewing the home from Excelsior Ave. See
photos. If I downsize to a smaller shed in the same position to fit within the zoning guidelines, I would need a shed that
has a width of 6'.A shed 6'wide would not be sufficient for storage and privacy.
The only solution is to have the two pine trees removed and move the shed approximately an additional 3'9" off the
property line to abide by the 5' set back. I am seeking approval for this variance since this would be a very costly
endeavor due to the two pine trees and close proximity of the powerlines. I've checked with National Grid and they
stated they will not remove the trees and suggested I hire someone private to remove them. I have sought out several
tree removal companies and they will not take on this project due to the very close and dangerous proximity of the
power lines alone.
I have spent a tremendous amount of time and resources improving my property and curb appeal. I have lost a
significant amount of privacy and curb appeal due to the new Greenbelt Trail and there are additional parking issues on
Loughberry Rd. South that still need to be addressed.The shed in its current position helps address my privacy issues
along Loughberry Rd. South that recently have gotten worse from the Greenbelt Trail. I would prefer to preserve the two
pine trees since they add natural beauty to the property and neighborhood since other trees were removed due to the
Greenbelt Trail.
I am asking the board to please approve this variance to allow my shed to sit 15" off my side property line as opposed to
the 5' zoning requirement.Thank you for your consideration.
