Re: 303 Nelson Avenue Area Variance application
Dear Josue Flores,
It has been brought to the attention of the Zoning Board of Appeals that the variance granted to 303
Nelson Avenue in the City of Saratoga Springs, New York 12866, on December 06, 2021, has been
invalidated due to the Applicant's failure to complete the neighbor noticing requirement.
Since the variance is no longer valid, all subsequent building permits reliant on the variances should be
suspended until the appropriate measures have been taken, including reopening the public hearing and
reevaluating the application. If approved,then the relevant permits can resume.
All other noticing and application requirements have been met. The Applicant is required to reapply to
the City Zoning Board and conduct the required noticing.
Please take the necessary steps to ensure that building/construction is halted until the required procedure
has been followed.
