In accordance with SEQRA regulations 6NYCRR Part 6 I 7 and after review and evaluation of the SEQRA short Environmental Assessment Form Parts I and II, made a motion to issue a Negative SEQRA Declaration on June 9, 2022; And, in accordance with requirements set forth in the City's Subdivision Regulations, the Planning Board issued the following decision: C� Approve the final subdivision plat with the following conditions: • Remove future sanitary sewer connection shown within easement area on lot 3 on final plans. • Final plans shall be to the satisfaction of DPW and the City's Designated Engineer for the application, Laberge. • Individual lot layout and architectural design shall feature prominent front porches and garages behind the front facades and toward the rear of the property to be consistent with the existing vernacular of the neighborhood. • Three street trees shall be installed along the Nelson Ave. frontage. • The applicant agrees to end construction period at 8pm nightly. • Payment of the fee in lieu of dedication of recreation lands for three new lots. Note: Any proposed further subdivision of lot 4 will be reviewed as an amendment to this subdivision application including continuation of prior SEQRA review. The applicant is required to complete the following as per the City of Saratoga Springs Subdivision Regulations: • Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on-and off-site improvements. • Submit a fee in lieu of recreation of $2,000 for each new residential lot per Appendix A of the Subdivision Regulations. • Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by the Planning Board Chair. • File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as provided in Article 3, Section 32 of General City Law. This approval shall expire if not enacted within I 80 days as set forth in the City of Saratoga Springs Subdivision Regulations Article II, Section I. D.I 5.
