Hello Emma,
I will add these comments to the public record, and they will be
discussed at the meeting; that being said, please see my
responses to your two questions below in blue:
1.) Due to the extremely minimal footage on our property line,
we are concerned with the insurance liability of construction
workers. After reviewing the variance application online, we
acknowledge the various liability certificates for individual
contractors, but none of these state liability coverage for us if
they are injured on our property and not on 29 Waterbury
Street.

The liability if an accident from a project would be covered
during the building permitting issuance phase and is covered by
the applicant's home insurance our their contractors. The
applicant, in this case, is asking for a 2.5ft setback from your
shared property line; this is considered 50% relief and is an
increased setback from the current 1.5ft. When deciding on an
area variance, the Board considers five criteria. Typically, if the
ask is not a detriment to the health, safety, and welfare of the
community, they are often granted. Also, the board look at the
neighborhood and how consistent or common this ask is, and
how it would affect the character- the garage has been existing
for -/+ 40 years. In our phone call, you mentioned you have no
issue with the garage location. However, your concern was the
liability in the event of an accident and the placement of
construction material; both are civil law concerns and are not
dealt with by the Zoning Board. The Board primarily looks at the
physical relief being requested.
2.) Due to the extremely minimal footage on our property line,
we are also concerned about the removal of demolition
materials and construction debris in and around our property.
We often have our young grandchildren at our home who play
in a sandbox, which is located close to the property line and
near the garage in question. Their safety is our concern.
These are civil law issues not typically covered by the Zoning
Board; however, I would expect the applicant to keep
construction material on their property; otherwise, you may
decide to pursue litigation

Dear Aneisha,
Per our phone conversation on the afternoon of Friday, 7/22, I'm listing
my questions and concerns (below) regarding the variance application
requested by the owners at 29 Waterbury Street. Please note my
husband and I do not have access to Zoom, so the below concerns
must be entered as official meeting business given we won't be present
at the 7/252022 meeting.
As a reminder, we received our notification about the scheduled
7/25/2022 Zoning Board of Appeals meeting on 7/21/2022 when the
official letter was delivered by the US Mail carrier, therefore not within
our 7 day window and addressed improperly (see attached). Given our
attorney is away on vacation and with little turnaround time we were
given, please refer to our below questions - noting, we may have

additional follow-up questions based on your supplied answers and after
we confer with our attorney later next week.
