New development in the last two decades within Saratoga Spring� ha�created a significant sacio-
economic ga�, largely eliminating the a�ility far those who make under S�5,400 to�e aGle to afford to live
in the city. Land for c�nstruction of necessary wvark force hausing ta address this issue is scarce and
expensive, especiafly in close proximify to jabs. In 2��0, the pandemic created a perfect starm to
exacerbate this growing gap. Sarataga s real estate market became highly competitive, with �rop�rty
values skyracketing as supply remained low. Ai the same time, the work farce dwindle�, with most
employers having huge difficulty staffing pasitians acrass all se�tors a!jobs. Mast natab4y, the heaflh care
and hospitality sectors had the mast vacancies. Sin�e ihat time, Saratoga's emplayers have been lacking in
staff needed to fill the jobs that provide the foundatianal suppart ta Saratoga's economic engine. Same of
the largest employers in Sarataga have noted thaf fess fhan 'I<of their work farce lives within the 12866-zip
code. Attracting empiayees with housing in Saratoga Springs is key to recruitment and retentian of warkers.
Liberty'�'ork Force Developm�r�t Team ("Liberty"} seeks ta build +1- 2Ua apartments in twa four story
structures on the interior�f the sit�, with an entrance on 8unny La€c� C�rive. This tlevelopment can a�ly
accur if the City C�uncil grants a map amendm�nt ta modify the current zoning fr�m Rft to UR-4.
The site �s a Urooded 3Q-��re lat on the corner of J�fferson St�eet antl Crescer�t Avenue. As shawn in �he
site plar�, #he [ot contains 9 acres af w�tlands that create a naturai buffer t� the closest resid�ntial
neighhors. More than 2D acres af Ehe site will remain unchanged, with the exception of Erails which wilf allaw
#he put�lic to circulate through the beautEful natural site. The Li�er�y developmenf seeks ta attract wark farce
hausing. To qualify to appl}+f�� an apartment at Liberty Sarataga Apartments; the pat�ntial
tenanUhousehold verified incame range will be appraximately 544,52Q-$84,80� �2fl22 HUD income Gmits�.
Thi� praject tarc�ets 60-8Q°lo of the average median incame (AMIJ #ar the Albany-Schenectady-Tray, NY
regian, which incl€�des Saratoga County. The median family income in thls region is 51�6,OOQ.
These ineome levels far this developm�nt are in the range of em�loyees such as teach�rs, young
professiona�s, nurses, ho�pitality industry, fire fighters and palice. The devekopment of this site wEl! pravide
a mechanism for empioyers to entice critical wark farce and allaw those integral to the operations within our
community to live and work in same place. 7he benefits of this apartment complex �re n�meraus. The
vibrancy of the Saratoga Sprin�s c�mmunity will provide an incer�tive for warkers to relacate here, close to
the services they provide. This cuts down fln the city's overall carban faotprin� by reducing the number of
trips into and out of the city. Tax dollars earned here will then remain here, as warkers stay and play in our
cammunity To kaep the Sarataga 5prings community vibrant, businesses, restaurants antl storefronts
must remain apen, we must have fire an� palice prot�cEion, and aur Ghildren must be educated. Attracti�n
and re�ention have became critical to maintaining su�ficient work force in our cammunity.
Given the lirnited areas left in the city with sufficient acreage to make a sigrrifEcant dent in the large housing
need, we request an amendment of tf�re �oning map to allow far tl�is construction ta accur. The �raperty is
currently zorted RR, whieh would allow far single family f�omes on 2 acr� lots. The �eneft for single family
f�ousing is largely outweighetl by the necessity af attrac#ing w�rkers to the c6ty. The applkcant seeks to
extend the kJR-4 zone lacated on �he adjacent Clubhause Drive prqperties across Jeffersan Street in arder
t❑ make this property consistent with the surrounding neighbarhantls. The UR-4 zone is found ir� several
locations on both fhe east and west sides of Jeffersan 5treet within a haif mile of the site. The�oning in the

area fnclutles UR-�, UR-4, R-MHP antl INST-HTR in the areas avaifable for development, with INST-PR an
�he preserve� parklantls nn the oppasite side �f Crescent. Following the grant of an amerrdment ta the
zone, the project will seek a height variance from the z�ning board and site plan review fram the planning
board.
Standar�s for Map Amendments
Z❑ning ma� amendmen�decisions are discretiar�ary by the legislative body af t�e city of 5aratoga S�rings,
ie. the City Gouncif, and upon recommendation by �he PEanning 8aard. In rendering their recornmendatipn
and ultimate decis�Dn, the L1�Q arCiculates#ive standards which, while nol mandatory, should be
cor�sidered by the Councip and P�anning Baard, The five legal standards for zaning map amendr�ents are
set forth belaw.
UD(7 Map Amendment 5tandard #1:
The consistency af the proppsed am�n�ment with the Camprehensive Plan
and associated adop#ed iand use pali�ies.
The 2�15 Compreher�sive Plan (hereinafter sametimes the "Plan" ar"Comp PEan"} articulates that the
braad vision for the city is sustainability, 7he "overriding philasophy tha�will guide future develop�nent af
❑ur"City in the Country" will be sustainability. Sustainable development meets the needs af the present
without compramising the ability af future generations ta meet their awn needs. Sustaina�le developmer�t

Tf�e city's dawntown was fo+�nded �n taurism, initially for the curative watersfsprings, then far horse racing
and the vi�rant downtativn, and now as a year-round des#ination with numeraus attractions. Throughout the
various phases af growth, the city has always had a strong warkfarce supporting the ecanomic gen�rators
of tourism Thes� incEude nat only the warkers that staff hatels, bars and restaurants, �ut al�o those tivha
are educatir�g future generations, caring for our community in aur medical faciEiti�s, and prolecting us from
fires and crime. In early 20D0, the ability for essential workers ta live in the c�ty started to change as the
hausing prices jumpetl drastically. Another significanf bump in housing values came during the pandemic,
which saw�ouble digit increases irr property and rentaQ values as the demand far housing in khe city

in�reased. In the last two deca�es, t�re gap between the work �orce antl thase wha are �uying hornes in [he

significantly year to year As the gap becames greater, we have seen the ability far businesses to attr�ct
and retain emplayees dwindle, resulting in a work force that must eommute into the city for work. Those
same warkers feave the city at the end af their shift with hard earr�ed tax dallars, which then are spent in
other cammunities where they reside. This madel is not sustaina�l�for the city, and we are c�rrently seeing
the impact of staffing sf�artages acros� a!I secfors af the city's econamy. For exampie, in early 2D22,
Wesley n�rsing home cEased two wings of the facility because of staffing issues. Downtown rest�urants are
unable ta o�en i days a w��k withQut the staff to cover the shifts. Alferdice has a � monfh wait ta get
sor�eone to a residence to provide a quote f�r a �raken window.All af these variQ�rs factors, combined
together, have a drastic impact on Saratoga's�canomy.
The Plar� highlighfs goals which this project supparts, including: seeking to preserve an ecan�mically strong
and adequately diversifietl c€ty with employment op�ortunities for ail its citizens, ta enco�rage develapment
benefitting the tax base antl is basetl on sustainable concepts, to "preserve and e�nhanc� a �ity tha# is

Cannectar. This anticipated new traii system �onr�ects residents thraugh the park trails; enabling thase on
the Wesf side to travel fram fheRr homes, down Creseent and ir�to lhe Spa 5tate Park. Bikers and
pedestrians could then pick up the Raifraad Run trail, go inta or pas(�he YMCA and would arrive nn

Tne welfare of the community is dependent, in large part, on the ability to pay f�r the services f�e city
requires ta function. Our economy is impacted by staffir�g shortages, in cumulative ways that cannot.
cor�tinue, ff the continuation of staffing shortages causes good businesses to clase, ar even decline, the tax
base will be reduced. To keep aur community vibrant, safe and healthy, businesses, restauranfs antl
s#arefronts need ta remain apen. Liberty SaratQga Apartmer�ts wil6 pravide a sma�l measure of assistan�e in

The suita�ility af the property for th� purposes fQr which it is presently zoned,
ie, the feasibility of develaping the prQperty in question for one car more
of the uses permitted under the existing zQning classificatian.
This property is currently zanetl RR whtich can be best described as 2 a�re residentiai zoning Under the
Ua�, fhe predaminant permit#ed uses are residential or agricultura[, with a few other specially permitted
uses allowed. The property has 30 acres, wf�ich would result in 15 estate' type fots, at most. Given fhe
current market in the city, these IoEs wauld ga at a premium for the land and w�uld require houses in
excess of$1 5 million tQ be�onskructed to ju�tify the land acquisition fe�s However, this area may nat be
desirable for estate lots at�his price point. In additian, a suhdivision da create esfate lots wauld nQt have t�te
amenities that Liberty is propasing which benefit the neighborh�ods nearby and thase recreating within the

Crescent Avenue Connector seems unlikely— ins�ead the cnnnections would �e along ,�efferson and
Cresent, a less p:cluresque route.
Gf you review the aaning map, this �arcel stands aut iike a thumb with it's green shading tha� is nat
connecte� ta any other RR zane. Instead, �his area is characteri�ed and surrountled by the higher dens�ty
UR-2, UR-4 and mobile hame park districts, together with tt�e Racino and Track praper[�es that attract a
si�nificant number af Uisitors. The RR z�ne and 2 acre housing is an anomaly here. The greenbelt is
present an the ather side af Crese�t Streek and provides the appropriate b�ffer c�nsisfent with the
greenbelt fdeal.
Given the scarcity of land within th�e cily and flwner and deve�oper's keen interest in vacant land, it is �lear
that this praperty is nof appropria�ely zaned. If it were zaned correctly, it wouid have been developed for an
allowa�l� purpose within the last few decades when the need for develop�ble property has �een at record
highs.

The propased rezaning will eliminate a nonconforming parcel within th�s area. As you can see fram viewing
the �onin� map, this is a single property with Rural Residential zoning, surrounded by praper�ies with much
denser urban residential uses and the actiue Racino prope�ty. Based on infnrmatian from the prior
Comprehensive �lan �ommitfee's meetings, fhis parcef was singl�d o�rt to remasn essentially
undevelapable because of the fear that the Racino wauld expand into this site and create fa�ilities in
campetition with the downtawn. 8y keeping this parce� zoned RR, it essentially rendered a privately owned
parcel undevelapab8e. 7he land is tao valuable to use it as zoned. Resid�ntial lots for high value estate
praperties are not desirable in this locatian. Keeping the stand alone site �oned �2R prevents it fr�m
development in the more creative�orm of the PU�, as the RR za�e is the only distnct which is una�l�ta
develnp with a PUD.
In other areas where the RR zone is located; tF�ere are many parcels locaked togefher far the p�.rrposes af
creating the greenbelt. This praperty is nof includetl in the greenbeft and should nat have been zanetl RR.
Instead, extending the adjace�t and nearby UR-4 zoning is mQre consistent with the develapment of the
praperty �nd Ehe adjacent uses.

department and additional equipmer�t will not be necessary bas�d on Ehe size of the prapased structures.
There is an abundance af park and recreati❑nal lands avai�able ta service the site. The saccer fiefds are
aGrass 8unny Lake Drive. The Heminck krails are available across Cresent. The Crescent Canne�tar will
be canstructed and serv� as a link fc�lhe Spa 5tate Park.
The site will be accessed by a private raadway �unny Lake arive. A traffic study was �erformetl ir� 2a�9
basetl on the priar project which had six less units, but afmost 100 additional bedroams. The site functi�ns
from a tra�fic standpoint and no a�ditignal capacity related mitigation measures were recommendetl.
Additional informatian regarding income qualification
ir� cannection with ather apartment develapments within the City, concerns have been raised about the
City's ability ta manitor the income qualifi�ations af the #enants at a �arlicular praperty locatian on an
ongoing basis. The City �oes not have a mechanism to Erack whether the rental units continue to be rented
to those wha meet the ir�came quaiifications. The L�berty d�velopments will not require the City ta manitar
the income of the fenanfs; as t�e funding far this tlevel�pment i� dependent upon ��nant income
certifications ta the State of New Yark an an a�nual k�asis. The oversighf of this income verification will be
per�ormed by CRM Rental Management, Inc., a lang-term partner and management agerrt far Liherty. CRM
mus�certify tenanf eligibility and incomes ta the New Yark State Hous�ng Finance Agency �"HFA"} an� the
tax credit equi�y investar for the development HFA will pravide the m�rtgage loan financing of this project
along wif� a tax credit equity investment fram � tax credif investor being the other primary sour�e af
finan�ing.
Pn connection with HFA's role as the mortgage lender, HFA will require the prajecf owner to enter into a
regulatory agreement for a minimum term of 40 years wh�ich is recorded against the real esfate in the
Saratoga Caunty Clerk's Office. The regulatory agreement wiil cantain provisions which restrict tenant
occupancy based �n qualified incom�s The prQperty otivner is required to �ertify to HFA on an annual
