I , in the City of Saratoga Springs, on an application for a 2-lot conservation subdivision within the Rural Residential District with the Planning Board who met on February I 3, 2020 and made the following decision(s) with a 6-0- I vote (In favor: Torpey, Totino, Fabozzi, Horton, Boivin, Mayo): In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified this request as an Unlisted Action. C� Issued a Negative SEQRA Declaration on February I 3, 2020 C� Issued final approval of a 2-lot conservation subdivision as per the requirements set forth in the City of Saratoga Springs Subdivision Regulations with the following conditions: • Add a minimum 20' no-cut buffer along Ruggles Road. • The final plan and conservation easement language shall reference the Planning Board's Conservation Area and No-Cut Buffer Policy. • The conservation easement language shall include enforcement by the two property owners of the provisions of the conservation easement. • Final conservation easement language to be approved by the City attorney. • Final plans shall be provided to the satisfaction of the City's designated engineer and DPW. • Orange construction fencing shall be installed to delineate no-cut buffer areas and conservation areas prior to clearing, cutting, site work, and construction. • Chair shall review and approve a signage plan that will permanently delineate conservation areas. The applicant is required to complete the following as per the City of Saratoga Springs Subdivision Regulations: • Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and off-site improvements. • Submit a fee in lieu of recreational lands of $2,000 for each new residential lot per Appendix A of the Subdivision Regulations. • Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by the Planning Board Chair. • File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as provided in Article 3, Section 32 of General City Law. This approval shall expire if not enacted within I 80 days as set forth in the City of Saratoga Springs Subdivision Regulations Article II, Section I. D. I 5.
