HomeMy WebLinkAbout20210989 Stewarts Shop 402 Lake Correspondance �t�«�t'� ��a� June 13, 2022 Mark Torpey, Chairman Saratoga Springs Planning Board 474 Broadway Saratoga Springs,NY 12866 RE: Stewart's Shop#101 402 Lake Ave. Saratoga Springs,NY 12866 PB# 20210989 Dear Chairman Torpey: Please see the following Stewart's responses to the Barton and Loguidice comment letter dated 5/19/22 concerning the above referenced project: Installation of Sidewalks alon�the Proiect Perimeter Stewart's Response: While Stewart's understands the need for pedestrian mobiliry, there is no sidewalk within the unmediate vicinity with which to connect. The appropriateness of the side of Lake Avenue for the installation of sidewalks in an ongoing discussion at the city and it is equally likely that the sidewalk connection will be located on the north side,rather than on the project's land to the south of Lake Avenue. Therefore, Stewart's proposes to make a contribution to the City's "Missing Link"progra�n which is expected to be extended to the Outer District at some point in the future. In the meantime, the contribution will enable the City to utilize the funds as necessary and its discretion. According to enQineer's estimate the contribution for Ste��art's shoulcl be S22,000. Complete Streets Advisory Panel The Board is concerned about continuous safe bicycle access through the Weibel Avenue Intersection. There are on-street bicycle lanes on Lake Avenue between downtown and a location several blocks to the west of the Stewarts Store. To the east of the store, there are wide shoulders, very suitable for bicycles. There are large number of cyclists in the area, as well as pedestrians. One Board member's recollection is that there was a fatal bicycle crash at this location. The Board's understanding is that in the eastbound direction, the shoulder will be continuous through the intersection and past the store. This would seem to be suitable. In the eastbound direction,however, it is unclear to the Board if the shoulder is continuous through the intersection. We request that a bicycle lane be added between the through eastbound travel lane and the right-turn lane. The appropriate width of the bicycle lane should be determined by the traffic engineers. If this is unfeasible,then the Board recommends that a westbound shoulder of four feet in width should be maintained through the intersection. Page � 1 �t�«�,t'� ��a� Stewart's Response: The installation of a dedicated bicycle lane along Lake Avenue (NYS 29)would require widening east of Gilbert Road and would impact both the existing guiderail and would occupy lands which are already under NYSDOT control for the drainage easement that crosses Lake Avenue and discharges to the swale. While Stewart's is committed to work with the Planning Board and City to the extent it controls land,unlike the new and necessary traffic signal,the inclusion of a dedicated bike lane was not included in the development of the Negative Declaration for impact mitigation for the project and requires the iuiprovement of lands which do not belong to the applicant. For these reasons, Stewart's position is that the installation of a bike lane is not feasible pursuant to the tenns of the City's Complete Street recommendation letter. Consistent with the letter, Stewart's proposes that the westbound shoulder of four feet in width be maintained through the intersection. The applicant's consultant, Anthony Christian,P.E. of CME,worked through a variery of alternatives, but ultiuiately the taper length and road width constrained the design to shoulder unproveinents which is an improveinent over existing conditions. General L The response letter indicated Creighton manning Engineering is working with NYSDOT regarding new easterly driveway orientation and traffic signals changes. Please provide correspondence and status in next submission. Stewart's Response: Comment ackno��leclgecl. DOT communications are attachecl. 2. The suggested hours for refuse pickup between 7am and 7pm and excluding 7 pm to 7 am is not a known condition of approval but appropriate signage is intended to avoid complaints, be a good neighbor in a residential neighborhood(Gilbert Road) as this operation is typically loud. Stewart's Response: Comment acknowledged. There are currently no neighbors so this could be an element of future development. 3. Response letter indicates building design is before the DRC and gutter, downspouts and ice machine (and all exterior equipment)will be shown and will be added once an amenable design has been achieved. They are in fact on the plans and routed appropriately. Ste��art's Response: Item aciclressed in clesign. 4. Concrete barriers in response to end of driveway could be more pleasing to the eye and upgrade the appearance by consideration of using faux rock texture (form liners with the precast concrete barriers) or other means. This may be in place for some time. Stewart's Response: Comment acknowledged and a masonry product with stone appearance will be sourced. 5. Complete construction sequencing plan once results of intersection improvements with NYSDOT are known and incorporate in final SWPPP documents and next submission please Stewart's Response: A phasing plan has been added to the plan set. We suspect the 8`h project phase listed(start pumping fuel)refers to testing and commissioning of the newly installed gas dispensing systems and not sales to the public. Please clarify because in that phase the typical shut-off may be needed by the installers if there is a problem and needs to be operable before pumping fuel. Please confirm there is aprotocol,likely already established by Stewart's standards, that ensures construction workers and subsequent Stewart's shop staff all are trained as to when that gas shut-off is to be used and subsequent emergency procedures and notifications. Stewart's Response: All partners are trained to NYSDEC Class C Operator standard. The reference to "start pumping fueP' is in fact dispensing fuel to the public. Pursuant to our installation guidelines, all equipment is inspected by certified technicians of the installers. Cost estimate for Letter of Credit 1. Item 11, (1)Bike rack at$135.00 seems quite low. It seems more than 1 bike space is justified. Please clarify. Stewart's Response: Itemizecl pricing from Ste��art's supplier is attachecl, most recently paicl �170/rack ancl pricing appropriately increased. 2. Item 12, ((9) site lighting and conduits) seems quite low,particularly with the trenching included. I often see $2,500 for each without the trenching. Please clarify. Stewart's Response: Stewart's purchases the light heads,poles, and wire in bulk and warehouses the materials. This is part of our vertical integration model and buying in bulk helps us secure better pricing. However,the cost has been updated to $3,000 to align with previous pricing as witnessed by the ciry. 3. Item 18,Pump station, seems low for a duplex pump station. They were close to $15,000 several years ago. Stewart's Response: The cost has been changed to $15,000 to align with previous pricing as witnessecl by the ciry. 4. Other than the topsoil the planting costs for perennials and shrubs seem very low even without installation. The reliability of shrubs and plantings are dependent on adequate siae selections and first year care. See comments on Landscaping in plan comments section. Stewart's Response: These costs are taken from the most recent landscaping proposal supplied to Stewart's. Our preferred landscapers get a good ainount of work from us and have their own greenhouses to procure plants from. This pricing and plant sizing is in line with what we've been paying. Page � 3 �t�«�,t'� ��a� SwPPP 1. What is the proposed plan for gutters at building to discharge to system? Stewart's Response: The stormwater from the gutters and downspouts are to be tied into the proposed closed drainage system,routed through the proposed oiUwater separator and hydroclynamic separator for treatment ancl then infiltrated into the existing on-site soils. 2. Include total sf of store with shed in first sentence to reflect 4,130 SF. Stewart's Response: Comment acknowledged. The plans have not changed since the issuance of the necessary relief. 3. What is status of well abandonment? Stewart's Response: Stewart's has received permission from Anderson Holdings,LLC. to close the well. Stewart's is in the process of investigating the depth of the well to bedrock and the intention is for the well to be cut and capped to bedrock depth, in accordance with guidance outlinecl in NYSDEC CP-43. 4. In section 9, exhibits,Flood mapping, ORRHP and NYSDEC letters were not included but listed in table of contents. Please include in SWPPP as intended Stewart's Response: These documents are included in "Exhibit A". As a component of the SEQR determination the OPRHP letter of"No Impact" dated September 15,2020, and the NYSDEC letter of"No Jurisdiction" dated August 19, 2020,were previously provided and are included again��ith this submission. 5. Discuss pre-treatment for infiltration system via proprietary unit and include in model for peak flow determinations that need to be considered for peak treatment and overflow capacity. The post development routing diagram indicates an existing OWS device. Is this an existing or new device as there is a detail on the plans for one with a 12-inch diameter device. The SWPPP contains a model FD-3HC (3' diameter)with a peak rate of 0.84 cfs to pretreat ahead of the drywell (DA#4). Both will require routine pump-outs. Stewart's Response: As generated stormwater runoff will contain areas considered to be a "hotspot",redundant treatment of 100% of the WQv is required prior to infiltration. This will be achieved through the use of a properly sized hydrodyna�nic separator and an oiUwater separator. The oiUwater separator shown in the Post Development stormwater model is a proposed structure and peak treatment flow calculations are located in the SWPPP exhibits. Also contained in the SWPPP exhibits is manufacturer provided data that shows both the peak treatment capaciry and the peak bypass capaciry of the selected unit. The data supports the selection of the proposed hydrodyna�nic unit. It is acknowledged that all pretreatment devices require routine pump outs. Pwnp outs are detennined via routine inspection. Inspections will be conducted annually,results documented, and pump outs scheduled when accuinulated sediuients reach the maximum level allowed per manufacturers recommendations. Stewart's Response: Comment acknowledged, and modifications carried through. Existing Site Plan- 1. Include demolition and any tank or OWS facility removals and notes for expedient removal. Ste��art's Response: These notes have been adclecl to sheet S-1. 2. Is there an existing survey map as the basis of the metes and bounds? Stewart's Response: The Existing Site Plan (S-1) is based off a 2015 survey by Drew Schauffert, PLS. Proposed site Plan 1. Update easement data with Andersons apparently connected to road plan finaliaation in next submission. Stewart's Response: The arranQement��ith Anclerson Holclinas, LLC is that upon "finale clesiQn" the easement would be finalized. The existing easement was filed via lnstrument Number � 2021019325 in the Saratoga Counry Clerk's office. Grading Plan 1. Where is concrete versus asphalt curb proposed? There should be a curb or asphalt curb at the top of the graded slope on the southeast corner of the new store? Is a guiderail proposed at the top of that slope to prevent errant drivers going down the slope? Stewart's Response: The inspection ports have been added in the Stormwater Management plan. Landscaping Plan 1. We recommend additional landscaping east of the store to break up expanse of lawn without encroaching near dumpster locations. Good place for an outdoor picnic table as some people prefer the sun or be near their motorcycles. Stewart's Response: While we understand the need for picnic, we disagree with the placement adj acent to the dumpster enclosure. The area was shown without plantings because Section 3.0 of the Creighton Manning Traffic Study dated February 2020 called for clearing in this area to improve the line of sight for exiting customers onto Gilbert. Low profile plantings can be placed in closestproximiry to the dumpster enclosure with taller species immediately adjacent. Sidewalk&parking Pad Plan L Note light broom finish on curb and sidewalk detail. It is noted elsewhere but should be on detail as well. The precast concrete drywell detail needs to show filter fabric at outside edge of 3' wide envelope of#3 stone. Angular stone works better. Include provision of that same stone inside footing ring to top of footing. Stewart's Response: Comment acknowledged and incorporated. 3. Add a 18" square by 6"deep rock or precast concrete below inlet pipe to dissipate energy of discharge and movement of stone and structure over time atop stone between footing ring. Stewart's Response: Comment acknowleclQecl and incorporatecl. Miscellaneous Details 1. Consider a larger bike rack or additional location for another. We conceptually approve the location the of the proposed driveway connection to the traffic signal on NY 29 along with the removal of the existing driveway. As the project progresses please submit detail plans along with stage 2 of the PERM 33- COM. Below are a few comments from our traffic staff: • This signal will need to be rebuilt due to its age (from 1978) and the need for additional loading to accommodate the new driveway. Plan for Video Detection at the new traffic signal. • We recommend restricting left turn out movements at proposed Gilbert Rd driveway. We understand this is a local road and that determination will be up to the municipality. • Truck circulation should be in through Gilbert Rd and exiting through the proposed traffic signal, if that is not already proposed.
