The Planning Board previously provided an advisory opinion to the City Council on text amendments to the Weibel Ave. PUD on August 12, 2021: Issued a favorable opinion on the requested text amendment to extend the expiration date of Zone B of the PUD from July I, 2012 to July I, 2024. This change to Section XI of the PUD, entitled Expirations would read, "Planned unit development zoning approval shall expire if final PUD site plan approval for the first building in Zone B is not granted on or before July I, 2024". Issued an unfavorable opinion on the requested text amendment to include "Warehouses, Distribution Plants and Wholesale Establishments" upon Site Plan Review approval within the PUD use schedule. The Board found that the current PUD language does not comport with the Community Mixed Use (CMU) designation in the Comprehensive Plan and therefore additional language would need to be included in the PUD that reflects the Transect - 4 Urban Neighborhood (T-4) or Transect 5 Neighborhood Center (T-5) design standards within the Zoning Ordinance. The most recently proposed text amendments (March 25, 2022 submission) were considered by the Planning Board on June 9 and June 23. The Board provides the following advisory opinion: Support amending Section III of the PUD, entitled Boundary, to reflect the seven updated tax map parcels which are subject to the PUD area. Support amending Section VI of the PUD, entitled Uses and Characteristics, to strike the limitation of the maximum commercial space in Zone B of the PUD de a general maximum square foot limitation on all proposed commercial space. Revised 7/6/2022 2:13 PM Proposed Text Amendments to Weibel Plaza PUD Planning Board Advisory Opinion Support development zoning approval shall expire if final PUD site plan approval for the first building in Zone Continue to find the addition of the new use "Warehouses, Distribution Plants and Wholesale Establishments" inconsistent with the Community Mixed Use (CMU) designation in the Comprehensive Plan. Support the addition of the new use Marijuana Dispensary and Marijuana Growing/Processing but as a use permitted with issuance of a special use permit and site plan review in Zone B only. The uses would also be subject to all NYS regulations and any standards within the UDO pertaining to the use. In addition to the requested text changes, the City Council has the authority to make any additional changes to the text of the PUD. The Planning Board provides the following additional suggested amendments: Any development or redevelopment in Zone A would be subject to design standards in T-5. Future projects in Zones A and B to provide pedestrian accommodations per SGBT Saratoga-Wilton connector during site plan review.
