Chairman Moore and Members of the ZBA,
I am unable to attend the meeting because of a conflict and ask my letter to be read aloud and inserted
in the official record.
I write today as a concerned resident of Saratoga Springs with reasonable professional knowledge in the
field of land use and permitting regarding #20190069 (Artisanal Brew Works).
The emphasis of my concern is what appears to be the retroactive taking of vested property rights by an
operator of a business. In my review of the documentation associated with the application, it seems
that Artisanal Brew Works went through the appropriate means of securing the necessary permits from
the City of Saratoga Springs including a Building Permit and upon construction to means acceptable to
the Building Department and established codes both the City's established zoning code the and
International Building Codes; a Certificate of Occupancy.
Now, it seems that the Building Department is reversing an internal determination without an
application being sent to the any of the City's land use board . As a resident, I am concerned with this
type of property taking when individual land owners (and their tenants) invest money and then have
their rights affected by arbitrary decisions of governmental entities. I am further concerned that this
type of activity opens theCity to litigation by aggrieved owners and could both potentially impact the
economic engine that is our hospitality and tourism industry butalso the costs of defending litigation
along with the potential damages associated with it.
I have full faith that the ZBA will evaluate the case on its merits and return Artisanars established rights,
