NOTICE OF DECISION
In the matter of the application

269 Broadway Site Plan

Involving the premises with tax parcel no. I 65.75-I-7 in the City of Saratoga Springs, on an application for site
plan review of a six-story multi-tenant commercial building and associated site work in the Transect—6 (T-6)
districts.
In accordance with SEQRA regulations 6 NYCRR Part 6 I 7, the Planning Board identified the proposed action as a
Type I Action, Coordinated Review, and as the designated Lead Agency for the review, evaluated the Full
Environmental Assessment Form Parts I and II, and made a motion to issue a Negative SEQRA Declaration on
November 18, 2021. The Planning Board reconsidered Part 2 of the FEAF and reissued a Negative SEQRA
Declaration on May 26, 2022.
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter
240, article 7.2 `Site Plan Review',the Planning Board issued the following decision on May 26, 2022 (passed 7-0
in favor: Torpey, Horton, Fabozzi, Mayo, Doty, Marshall, Pingel):
C� Approve site plan set with revision date May I 8, 2022 with the followin�conditions:
• Traffic mitigation improvements shall be installed and include the following per"Traffic Impact
Study 269 Broadway— Hamilton St." revised January I 9, 2022:
o Intersection 2 (Hamilton St.with West Circular St.)—add striped right turn land on the
southbound approach
o Intersection 3 (Hamilton St.with Congress St.)—modify the signal timing by moving I
second of green time from the east-west phases to the north/south phases.
• All deliveries will be required to use the designated loading zone along Hamilton St. as directed
to by the property owner to alleviate traffic disruption along Broadway(per TIS above). The
lease agreements with all building tenants shall require all deliveries be made exclusively to
Hamilton Street, not Broadway.
• Recommendations from the "CHA Comment Review Response and Hydrogeological Report"
provided by Terracon Consultants dated May I 8, 2022 shall be met and include the following:
o Additional test borings to be drilled prior to submittal of the construction documents to
the Building Department to refine the analysis and design for construction of the secant
pile wall and dewatering systems. These test borings will include soil sampling and

bedrock coring, and installation of groundwater monitoring wells. The wells will be
screened across the various surficial sediments encountered above the bedrock and
within the bedrock.
o In-situ testing of groundwater in the wells will be conducted to determine hydraulic
conductivity(K),transmissivity(T), and groundwater velocity(v). These aquifer
characteristics will be useful in designing the dewatering system for the project,which
will ultimately be the responsibility of the contractor and require review by the
Geotechnical Engineer of Record and the City Engineer.
o All additional testing and reports completed during the construction phase will be
provided to the City of Saratoga Springs.
• Applicant shall submit a detailed construction implementation plan to monitor groundwater
levels along with structure and ground movement during construction with its building permit
application. The plan shall include stop work thresholds and contingency plans for unexpected
conditions. The plan shall be signed-off by the City Engineer prior to issuance of the building
permit, and reports summarizing the monitoring program shall be prepared by the applicant's
geotechnical engineer and submitted to the City Engineer during the course of construction.
• A construction phase dewatering plan shall be submitted and approved by the City Engineer.
• A long-term permanent dewatering plan shall be submitted and approved by the City Engineer.
• The City Engineer shall have access to all groundwater and geotechnical data and analysis for
future projects.
• The applicant shall provide a pre-construction photo survey of all adjacent properties. This is
intended to serve as a baseline reference for assessing any impacts to neighboring properties.
• Applicant shall protect during construction and preserve the existing Elm tree located within
the treebelt along the Broadway frontage (a tree protection detail shall be added to the site
detail sheet in the final plan set).
• Applicant shall provide secured construction and photometric easements from both north side
properties to the satisfaction of the City Attorney's office and verify filing at Saratoga County.
• The applicant shall provide verification of sign-off from National Grid on the proposed location
of the switch gear and the transformers. If the proposed location is not acceptable to National
Grid then the applicant shall return to the Board for further review.
• The applicant shall address CHA remaining technical comments (review letter dated 5/24/22).
• The applicant shall provide final plans to the satisfaction of the City Engineer.
The applicant is required to:
I. Provide documentation of conformance with all required conditions of approval.
2. Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article
7.2.I 5 of the Zoning Ordinance. This must occur prior to final signature by the Planning Board
Chair.
3. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by
the Planning Board Chair within ei�hteen �I 8) months of approval as per Article 7.2.I 2 of the
Zoning Ordinance.
Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not
started actual construction as per Article 7.2.I 4 of the Zoning Ordinance.
