Saratoga Springs, NY 12866 Subdivision of a 2-lot conservation subdivision Tax Map#164.-1--23.1 Date May 16, 2019 20/90117 EBERLEIN SUBDIVISION Required notification of public meeting notice NOT MET • The required 20 - 7 day notice of the May 16, 2019 City of Saratoga Springs Planning Board meeting was not sent to the required 16 residents of Saratoga Springs. ® The Raga Family Trust DID NOT receive the required 20 - 7 day notice of the May 16, 2019 City of Saratoga Springs Planning Board meeting. O The Raga Family Trust received an Undated Public Hearing Notification Letter on the City of Saratoga Springs Planning Board letterhead addressed to Dear Property Owner and signed by Mark R. Torpey, Chair Planning Board and contact information for Jen Merriman provided. Att 8 O The meeting notice received by the Raga Family Trust was sent by regular mail via the United States Post Office, the post mark is not legible and the notice came in an envelope from another company with the name and address of the company obscured and a return address of"Office of Economic and Development" pasted over the original envelope. Att 7 O There is an appearance that the City of Saratoga Springs Planning Board and the Saratoga Springs Office of Planning & Economic Development are acting as an agent of the applicant. Based on the undated letter from the chair of the City of Saratoga Springs Planning Board sent from the "Office of Economic and Development" there is an appearance that the Saratoga Springs Office of Planning & Economic Development and the City of Saratoga Springs Planning Board are acting as an agent of the applicant. 20190117 EBERLEIN SUBDIVISION The proposed Eberlein subdivision is within the New York State (NYS) Freshwater Wetlands "check zone". The information regarding NYS Wetlands "check zone" below is obtained from the NYS Department of Environmental Conservation website. What is the NYS Freshwater Wetlands "check zone?" New York's freshwater wetlands maps only show the approximate location of the actual wetland boundary. They are not precise, regardless of how closely you zoom in on the map. The "check 1 zone" is an area around the mapped wetland in which the actual wetland may occur. If you are proposing a project that may encroach into this area, you should check with your regional DEC office to make sure where the actual wetland boundary is. If necessary, they may have a biologist come out and perform a field delineation for you to help you avoid impacts in the wetland or the regulated 100-foot buffer zone. The Eberlein subdivision applicant provided incorrect answers to the following questions on the Short Environmental Assessment Form (EAF). EAF Questions: 2. Does the proposed action require a permit, approval or funding from any other government Agency? If Yes, list agency(s) name and permit or approval: At a minimum the site is within the NYS Freshwater Wetlands "check zone". 3b. b. Total acreage to be physically disturbed? Given the topography of the site more than 0.9 acres will be physically disturbed. 6. Is the proposed action consistent with the predominant character of the existing built or natural landscape? The answer should be NO. 13b. Would the proposed action physically alter, or encroach into, any existing wetland or waterbody? If Yes, identify the wetland or waterbody and extent of alterations in square feet or acres: This question was left unanswered. The area is in the Wetland "check zone". 14. Identify the typical habitat types that occur on, or are likely to be found on the project site. Check all that apply: A potential Wetland was NOT indicated. 17. Will the proposed action create storm water discharge, either from point or non- point sources? If Yes, a. Will storm water discharges flow to adjacent properties? b. Will storm water discharges be directed to established conveyance systems (runoff and storm drains)? If Yes, briefly describe: The answer to all of these question should be YES. This area is a natural watershed drainage site which will be permanently negatively impacted by this subdivision. 18. Does the proposed action include construction or other activities that would result in the impoundment of water or other liquids (e. g., retention pond, waste lagoon, dam)? If Yes, explain the purpose and size of the impoundment: The answer to this question should be YES. 2 The Stormwater Pollution Prevention Plan (SWPPP). The subdivision applicant provided incorrect answers to questions 15,16,22 on the SWPPP and question 23 and 27-39 need to be answered since the answer to question 22 is incorrect. SWPPP Questions 15. Does the site runoff enter a separate storm sewer system (including roadside drains, swales, ditches, culverts, etc.)? The answer should be YES, the runoff goes to a culvert at the 50 Ruggles Rd., Saratoga Springs, NY property. Atts 5 and 6 16. The City of Saratoga Springs was NOT indicated as the municipality that manages the storm sewer system. 22. Does this construction activity require the development of a SWPPP that includes the post- construction stormwater management practice component (i.e. Runoff Reduction, Water Quality and Quantity Control practices/techniques? The answer should be YES and Questions 23 and 27-39 need to answered. Incorrect information provided on the EAF and SWPPP The applicant for the subdivision did not provide correct information on the Environmental Assessment Form (EAF) or the Stormwater Pollution Prevention Plan (SWPPP). • The proposed subdivision is on a steep slope/ridge/watershed. • The proposed subdivision is a natural drainage area steeply sloped on both sides which can be described as a slope/ridge or watershed area. • The proposed subdivision will require extensive tree removal and destruction of the natural slope/ridge/watershed of the site, will impact the current natural drainage area and will permanently negatively impact the natural drainage of the site. Atts 1-4 City of Saratoga Springs Residential Conservation Subdivision Ordinance • The Eberlein subdivision will impact all or some of the following activities prohibited by the City of Saratoga Springs Residential Conservation Subdivision Ordinance: filling, draining, cutting, flooding, dredging, impounding, clearing, burning, excavating, erecting, constructing, releasing wastes or otherwise doing any work or non- agricultural activity on the site. Footprint of residential structure shown on subdivision plans. The footprint of the residential structure drawn on the subdivision plan is totally unrealistic. The applicant implies that the size of a potential residence on the proposed subdivision will be approximately the size of a residential garage, about 960 sq.ft. ® The residential structure drawn on the proposed subdivision plan is a one level rectangle box that appears to have a footprint of approximately 24ft. x 40ft. or approx. a 960 sq.ft. residence with no additions such as porches or decks and no additional structures. 3 o This proposed residential footprint is totally unrealistic. For example: Geraldine M. Eberlein, the applicant's residence is 4552 sq. ft. with an attached garage of 736 sq.ft., a 70 sq.ft. porch and a 512 sq.st. pool. Total sq.ft. of residence and exterior additions 5,870 sq.ft. The Raga Family Trust OPPOSES the 20190117 EBERLEIN SUBDIVISION Construction activity on this site will permanently destroy a natural watershed drainage area. The proposed site should be physically assessed by appropriate staff of the City of Saratoga Springs. The Raga Family Trust 50 Ruggles Rd.
