NOTICE OF DECISION
In the matter of the Site Plan application - #I8.036
385 Broadway Mixed-use Building
385 Broadway
Saratoga Springs, NY 12866
involving the premises with tax parcel #165.59-I-77, in the City of Saratoga Springs, on an application
for site plan review for the construction of a mixed-use building including commercial and multi-family
residences in the Transect-6 Urban Core district.
In accordance with 6 NYCRR Part 617, the Planning Board, acting as SEQRA lead agent, issued a
negative declaration of environmental significance on October 18, 2018.
Record of vote: motion made by R Horton, seconded by J Casey: passed 6-0

Absent: R Bristol, C VanWagner
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance
Article 240-7.2 Site Plan Review, the Planning Board issues the following decision on October 18, 2018:
El Issue partial approval with the following conditions:
Infrastructure:
-Applicant to replace 185' of sanitary sewer(MH to MH) as recommended by the City Engineer.
Traffic/Parking:
-Applicant to construct a crosswalk across Division St. on the east side of Woodlawn Ave.
-Applicant agrees to$15,000 contribution for system-wide multi-modal transportation improvements.
Civic Space:
-Applicant to develop/construct streetscape improvements including public plaza space on Broadway
with wayfinding/interpretive signage. Applicant shall work with Planning Board small committee to
develop design. Note: Applicant to return to Board for final approval of plaza design and amenities.
-Applicant agrees to contribute$12,000 for development of Greenbelt Trail

Recreation Fees:
-The Board strongly recommends that the required recreation fees ($138,000) be earmarked for the
development of the Flat Rock Spring urban park and/or other proximate urban recreational
opportunities (e.g. Greenbelt Trail).
Other:
-Applicant to identify a point-of-contact person during construction to address neighbors' questions and
concerns.

The applicant is required to:
I. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the City
per Article 7.2.15 of the City of Saratoga Springs Zoning Ordinance. This must occur prior to final
signature by the Planning Board Chair.
2. Submit a fee in-lieu-of recreation of$2,000 for each new residential unit as per Article 7.2.18 of the
Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair.
3. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by the
Planning Board Chair within eighteen (18) months of approval as per Article 7.2.12 of the Zoning
Ordinance.
Note: this approval shall expire within eighteen (18) months of the signature of final plans if the
applicant has not started actual construction as per Article 7.2.14 of the Zoning Ordinance.
