APPEAL TO THE ZONING BOARD FOR AN
INTERPRETATION, USE VARIANCE,AREA VARIANCE AND/OR VARIANCE EXTENSION
APPLICATION REQUIREMENTS
1. ELIGIBILITY:To apply for relief from the City's Zoning Ordinance, an applicant must be the property owner(s)
or lessee, or have an option to lease or purchase the property in question. The Zoning Board of Appeals (ZBA)
shall not accept any application for appeal that includes a parcel which has a written violation from the Zoning
and Building Inspector that is not the subject of the application.
2. COMPLETE SUBMISSIONS: Applicants are encouraged to work with City staff to ensure a complete application.
The ZBA will only consider properly completed applications that contain of the
foll owin :
7Completed application pages I and 8, the pages relating to the requested relief(p. 2 for interpretation or
extension, pp. 3-5 for use variance, pp. 6-7 for area variance), and any additional supporting materials/
documentation. **HANDWRITTEN APPLICATIONS WILL NOT BE ACCEPTED**

Detailed "to scale" drawings of the proposed project—folded and no larger than 24"x 36". Identify all

Photographs showing the site and subject of your appeal, and its relationship to adjacent properties.

To grant an area variance,the ZBA must balance the benefits to the applicant and the health,safety,and welfare of the neighborhood and
community,taking into consideration the following:
I. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have
been explored(alternative designs,attempts to purchase land, etc.)and why they are not feasible.
We realized our rear property line was much closer than had been communicated to us by the prior owners/realtors during the
purchase process of our home after the addition drawings were completed by the architect.When we began filling out the building
permit application we discovered the setback requirements document.The original drawings from the architect were of the
proposed addition coming off the back of the house 24 ft.We explored moving the addition to the end of the house,but the septic
tank is located there.We then had the architect redraw the proposed addition plans and turn the structure so the proposed
addition comes off the back of the house 18 ft.We had the property resurveyed and discovered we were still short by
4.7 feet in order to be within compliance of the rear setback requirement of 50 ft.
2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby
properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood
character for the following reasons:
The proposed addition will not be visible from the street and will therefore not produce an undesirable change to the character of
the neighborhood or detriment to nearby properties.We have no neighbors in the rear of our property. Our property backs up to
the PBA athletic fields.

3. Whether the variance is substantial. The requested variance is not substantial for the following reasons:
The requested variance of 5 feet is not of considerable size therefore making it not substantial.
4. Whether the variance will have adverse physical or environmental effects on neighborhood or district. The requested variance will not
have an adverse physical or environmental effect on the neighborhood or district for the following reasons:
The variance will not have adverse physical or environmental effects on the neighborhood or district.The proposed addition is
designed/drawn to appear that it has always been a part of the home.We completed the environmental assessment paperwork
and nothing is flagged as an environmental impact.
5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain
whether the alleged difficulty was or was not self-created:
Yes,the difficulty was unfortunately self-created. We would never purchase a home again without requiring an updated survey
of the property,all setback zoning rules for the property and clearly marked property lines.The prior owners and realtors were
intentionally vague about the back property lines because it backs up to woods and the PBA athletic fields We discovered the
back property line is much closer to the house than we had originally thought.Also,our architect did not provide a site map
and is not familiar with zoning regulations.We planned on the proposed addition when we made the decision to purchase this
home and are now much more educated on the process after navigating this situation.

Notes:
1. All streets are to be offered for dedication to the City of
Saratoga Springs.
2. One "Hidden Driveway" sign shall be installed in the Old
Schuylerville Road right—of—way as approved by the City
Department of Public Safety.
3. The walking path shall be constructed of 6 inches of
compacted wood chips, 4 feet wide. The path shall be
installed within 100 feet area, no closer than 20 feet of
R.O.W. and no further than 80 feet of R.O.W. The path shall
meander within this specified area and shall offset as needed
to ovoid removal of trees or other significant vegetation.
4. The installation of driveways, water lines, communication
cables, etc, shall be restricted to c single swath that has a

5. Signage for the walking trail shall be provided as shown and

6. No construction vehicles shall enter the property from Lady
Slipper Court.
