Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have been explored(alternative designs,attempts to purchase land, etc.)and why they are not feasible. We realized our rear property line was much closer than had been communicated to us by the prior owners/realtors during the purchase process of our home after the addition drawings were completed by the architect.When we began filling out the building permit application we discovered the setback requirements document.The original drawings from the architect were of the proposed addition coming off the back of the house 24 ft.We explored moving the addition to the end of the house,but the septic tank is located there.We then had the architect redraw the proposed addition plans and turn the structure so the proposed addition comes off the back of the house 18 ft.We had the property resurveyed and discovered we were still short by 4.7 feet in order to be within compliance of the rear setback requirement of 50 ft. 2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: The proposed addition will not be visible from the street and will therefore not produce an undesirable change to the character of the neighborhood or detriment to nearby properties.We have no neighbors in the rear of our property. The requested variance is not substantial for the following reasons: The requested variance of 5 feet is not of considerable size therefore making it not substantial. 4. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: The variance will not have adverse physical or environmental effects on the neighborhood or district.The proposed addition is designed/drawn to appear that it has always been a part of the home.We completed the environmental assessment paperwork and nothing is flagged as an environmental impact. 5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain whether the alleged difficulty was or was not self-created: Yes,the difficulty was unfortunately self-created. We would never purchase a home again without requiring an updated survey of the property,all setback zoning rules for the property and clearly marked property lines.The prior owners and realtors were intentionally vague about the back property lines because it backs up to woods and the PBA athletic fields We discovered the back property line is much closer to the house than we had originally thought.Also,our architect did not provide a site map and is not familiar with zoning regulations.We planned on the proposed addition when we made the decision to purchase this home and are now much more educated on the process after navigating this situation.
