Please find our responses to your comment letter dated 12/10/21 below. Thank you for your review.
General
1. Please provide a brief project narrative that summarizes project site plan statistics,water
demand and sewer service,water service application, stormwater management system,
emergency fuel spill protections/system, complete streets checklist, and other pertinent
information
— The project narrative is attached.
2. Will existing water and sewer laterals be utilized? Is a water service connection agreement with
the city required?
— Please see attached revised plans filed with the city 3/21/22.
3. The plans lack detail for grading, drainage and utilities. Please advance plans and re-submit with
all information that a contractor would require to construct it. Plans seem to be in a concept
phase.

Water and Sanitary Sewer
1. Are existing service and lateral being utilized?Will any abandonment of existing utilities be
proposed?
— Please see attached revised plans filed with the city 3/21/22.
2. What is status of 0.367 acres of land conveyance and easements with the Andersons?
— Stewart's Shops closed via instrument 2021019324 on 6/1/21.
3. The narrative requested should outline the construction sequencing of the construction of the
new store and parking/access/egress of existing store if planned to remain open during
construction that emphasizes safety with appropriate planning and signage.
— Comment acknowledged and is included in the narrative.

4. What is status of submission and approval of new easterly driveway orientation and signal
cha nges by NYSDOT rega rdi ng NYS Route 29?
— Creighton Manning Engineering (CME) is working with NYSDOT and were directed to
proceed with the design phase on 3/17/22.
5. Provide a sign for refuse pick-up that prohibits refuse pick-up between the hours of 7 PM to
7AM to limit load noises to adjacent properties at night.
— There are no prior conditions of approval we are aware of requiring this condition.
Cost estimate for letter of Credit
1. Please provide a cost estimate for letter of credit.
— A cost estimate has been completed and is attached. The offsite cost for the road and
signal work has not been included because it will be turned over to the NYSDOT and not
the city.
SWPPP
1. No SWPPP or erosion and sediment control plan were submitted. What is the proposed plan
from gutters at building to discharge?
— Please see attached SWPPP and revised plans filed with the city 3/21/22.
Plans
T-1-Title Sheet/Elevations
1. Show gutters, downspouts and ice machine on elevations.
— We are currently before DRC for the building design. These can be added to the
elevations once an amenable design has been achieved.
Existing Site Plan-Existing Site Plan
1. What is the status of the existing well shown near the southwest corner of the site? Is this an
active well and how far is it from the proposed southerly fuel canopy?
— It is an inactive well and is 92' from our dispenser. The existing owner has been
contacted regarding potential closing.
S-2-Proposed Site Plan
1. What is proposed for barrier and/or signage at new end of driveway pavement in new Anderson
easement on west side of new store?
— We propose precast concrete barrier blocks with reflective decals.
2. A separate plan to show construction sequencing is recommended.
— We currently have the intersection improvement plans in work with CME and NYSDOT.
The sequencing is dependent on these plans. A phasing plan will be provided with a
future submission.
3. Remove reference to City of Albany project in note 20 and include note that city engineer's
office may wish to inspect stormwater basin.
— This comment seems to have been a carry over and not relevant to this project

S-6-Photometric Plan
1. Seems adequate. What KVA lighting is proposed at canopy and was that the basis for plan for
this site?
— Please see attached revised plans filed with the city 3/21/22.The luminaire schedule
specifies the color temp, luminaire watts, and luminaire lumens. The driver size and LED
count for each light that we use has evolved into a standard for Stewart's over years of
observation.
C-3,S-4 and S-5
1. The plan set skips sheets between S-2A and S-6. Please submit full set including grading plan.
— Please see attached revised plans filed with the city 3/21/22.
S-7 Vehicle routing Plan
1. Provide routing for refuse pick-up trucks.
— This will be added to the plan for a future submission. The plans now are as is when
filed to the city for consistency.

Stewart's Shops project narrative

Stewart's Shops is proposing a 4,130 square foot convenience store (3,975 ft2 store with an attached
155 ft2 shed). There will be two canopies for gasoline filling that will have 6 pumps (12 fueling positions)
tota I.
The site has been subject to a Negative SEQR Declaration dated July 29, 2021 when the Planning Board
acknowledged that the installation of a fourth leg to the signalized intersection at Lake Avenue (NYS 29)
and Weibel Avenue would eliminate the existing Lake Avenue driveway. Subsequent to this,the Zoning
Board of Appeals issued a series of Area Variances (#20200208) on September 27, 2021 and the Design
Review Commission acknowledged there is no adverse impact on architectural or historical buildings on
October 6, 2021 (#20210872).
The site will be lit via downlit LED fixtures with a kelvin temperature of 3,OOOk. When constructed the
building will be a wood framed structure with Hardie Board (concrete clap board) and stone veneer up
to 36" above finished floor. Fa�ade to be finalized with DRC.
The new shop will use the same sewer and water connections that service the existing shop. The
existing store utilizes an E-One grinder pump for sewer. A new pump will be installed in a new location
and the discharge will tie into the existing line that carries flows to the City's pump station.
Stormwater management for the new site has been designed in accordance with the NYSDEC
Stormwater design manual and a SPEDES permit will be procured once the site design is finalized, and
city approvals have been granted.
Project phases are as follows:
1. The project will commence with the construction of the southern leg of the Lake Ave/Weibel
intersection and signal to provide access to the site and eliminate Stewart's access on Lake Ave.
2. Construction will begin on the new Stewart's building behind the existing shop. The existing
shop will remain open with parking during this stage and construction will be isolated to behind
the existing shop.
3. Open new shop utilizing the existing parking and the old shop will be closed, fenced off for
safety, emptied and demolished. The footprint of the old shop will be graded off with stone and
utilized for temporary parking.
4. Remove old tanks and canopies. During this phase, any possible contamination will be
mitigated.
5. Excavate for new fuel storage tanks, install tanks, and pour concrete tank pad.
6. Construct new canopies, pipe product, set dispensers, and pour canopy aprons.
