With regards to the car wash property, a special permit with conditions was issued by the Zoning Board of Appeals on May 26, 1976, authorizing Congress Gas & Oil Co., Inc. to construct a mechanical car wash". Building permit#8978 was issued on April 13, 1978 for cons ructio-'nofi"t e ch-arwasl'aciCi ies, which were like y comple d-inI ovem er of1-978-Sign permit#9156 was issued on October 30, 1978 for the freestanding sign. However, according to your survey drawing, this sign was improperly located off the car wash lot. A new permit will be required, after applicable board review/approval, to re-erect the sign on the car wash property. With regards to the Congress Gas & Oil property, although administrative offices for permitted industrial uses of the property in past years were permitted also, I can find no record that business offices" or"professional offices" alone were authorized uses on this parcel, and therefore I don't agree that there is a continual nonconforming use of the 8+ acre parcel. A Zoning Board of Appeals variance will be one of the necessary approvals you must seek in order for there to be commercial use of all or a portion of this property. I have included a survey of the property mentioned above for your review. We would like to clarify the zoning for this parcel. Currently the entire 7+acre parcel is used as office space for Congress Gas&Oil,Passaretti Geological,Aztech Technology and F.L.Fina PE. with various above ground storage tanks. On the map I have provided I have drawn a rough line where we would like to subdivide the property. We would then sell the small piece to Passaretti and the large piece would remain with Stewart's and adhere to the current zoning for that parcel. The smaller parcel would remain as a legal non- conforming business. I have completed a list ofthe uses of the property since 1987: Pre 1987 through current-Document starage and office space—Congress Gas&Oil and Marion Ave. 1992 through current—remediation for Congress—space used by Fill Fina and Mary Passaretti 1992 through 1995—R.J. Powers Excavating—office and heavy equipment storage 1992 through 1995—Passaretti and Fina—storage of remediaton equipment 1995 through current—Fil Fina PE—office space 1995 through current—Fil Fina PE and Mary Passaretti,DBA Fina and Passaretti—office space 1997 through current—Aztech Technology(Fina and Passaretti)—office space 1998 through current—Passaretti Geological—Mary Passaretti—office space I think you will find that there has been continual use of the property since pre 1987.
