NOTICE OF DECISION
In the matter of the application
#20211077
74 Mitchell Street Site Plan Review
Saratoga Springs, NY I 2866
Involving the premises with tax parcel no. I 66.70-I-I 7 in the City of Saratoga Springs, on an application for site
plan review for improvements associated with a private club, including a clubhouse and pool, in the Urban
Residential— 3 (UR-3) district.
In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA short
Environmental Assessment Form Parts I and 2, the Planning Board hereby resolves:
I. It has been discovered that the answer provided in EAF Part I in response to Question I 2 (a)was
erroneous.
2. At all times during the review of this Application, including during SEQRA review,this Board was
fully aware that the Project site is contiguous to the Historic District and at no time did this Board
misunderstand this circumstance or rely upon the response previously provided to Question I 2 (a).
3. The response to Question I 2 (a) has since been corrected on the record to reflect the Board's
understanding that the site is, in fact, contiguous to the Historic District.
4. The Planning Board hereby reaffirms and readopts its previous SEQRA Negative Declaration.
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter
240, article 7.2 "Site Plan Review",the Planning Board issues the following decision on May 5, 2022 (passed 7-0
in favor: Torpey, Horton, Fabozzi, Mayo, Doty, Marshall, Pingel):
C� Approve as presented with the following conditions:
I. The landing area at the rear of the property shall not be used as a parking area—"No Parking" signs to be
installed.
2. Extension of sidewalk and street trees on adjacent lots (70 and 76 Mitchell) shall be installed prior to
issuance of C.O. for those residences.
3. Installation of curbing and street lights on lots 70, 74, 76 Mitchell shall be installed at the discretion of
DPW prior to issuance of C.O. for each lot.
4. Final plans shall be provided to the satisfaction of DPW.
The applicant is required to:
I. Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article 7.2.I 5 of
the Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair.
2. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by the Planning
Board Chair within ei�hteen (I 8) months of approval as per Article 7.2.I 2 of the Zoning Ordinance.
Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not

started actual construction as per Article 7.2.I 4 of the Zoning Ordinance.
