Although the current owner purchased this property 30 years ago as a four-unit building, it was determined by City staff on November 27, 2018,that the property is a lawfully non-conforming(3) residential unit building built prior to Zoning established in 1961. The owner currently has four long-term tenants and if the building were to be converted to a three-family building it would require the eviction of one of the current tenants. A zoning variance for a fourth residential unit, by a previous owner,was denied on March 9, 1988, Therefore, based on the current zoning: Neighborhood Complimentary Use-1 (NCU-1),the owner is requesting a Special Use Permit for the fourth unit to be a first-floor commercial unit. It is currently occupied by an Artist Studio (Fashion Designer-not a residence for the artist) and is an 861 square foot unit meeting the zoning threshold of a maximum 1200 sf use as an Art Gallery,Artist Studio, Retail, Service-Establishments or Office space. Historically, as noted on the Saratoga Springs Preservation Board Building Inventory form,this structure was constructed to include first floor commercial retail and residential above. Per follow-up correspondence with City staff on May 2, 2019, the team was advised to apply for a Special Use Permit and Site Plan Review for the three(3) authorized lawfully non-conforming residential units and one(1) commercial unit which would bring the property into compliance. Please find attached to this letter a Special-Use Permit application, a Site Plan Review application including maps(drawings), a Short Environmental Assessment Form and associated application fees. A zoning variance for a fourth unit was previously denied on March 9, 1988. A (4) unit multifamily residence is not a permitted use in the NCU-1 district. A special use permit will be required for the (3) authorized lawfully non -conforming residential units and (1) commercial unit to be used. This will require site pian approval as well. Even with a Special Use Permit, the gross area of the commercial space shall be no greater than 1,200 sf for use as an Art Gallery, Artist Studio (which you mentioned is the current use), Retail, Service -Establishments, or Office space.
